The letter they sent me was addressed to me as my maiden name. I am reluctant to sign the letter as my marriage name. Should I sign the letter as my maiden name?

Court is exceptionally unlikely.
Aktiv are chancers, but they aren't daft enough to try that for a statute bared debt.
Whether to reply or not is always a judgement call.
Depends on whether a few letters with silly threats bothers you?
If it doesn't, then just ignore.
If you would rather get rid of these idiots, for example if they are hassling you with phone calls as well, or you just want to put a stop to this sooner rather than later, then use the appropriate letter.

I've ignored all correspondence from them, including the threats of sending field agents round, and they've finally given up... A couple of years ago I had a letter from Aktiva chasing me for a debt of £160.00 that was nothing to do with me. It just so happened that the person they wanted had the same surname as me but lived in Manchester. I have never lived there. At my request Aktiva sent me a letter confirming that the debt was nothing to do with me and they wouldn't go anywhere near my credit file. Recently I got a copy of my credit file and found there was a search on it from them even though I had a letter from them a couple of years ago admitting the debt wasn't mine.0

Hello again! Just an update, We have recieved a letter from Activ, with what looks like a doctored document, as almost all of the hand written form is readable apart from the date the form was signed, the day and month are visible, but not the year! its been soooo darkened its almost unreadable.
The letter we sent not only asked for a signed agreement, but also a full statement of account, which is still not been supplied, are we right to still dispute this? As they are now starting to harrass for payments to be set up again!0 -
Hi CeeJ, You still have a right to the statement of account. As to the document it should be legible, if it isn't then they couldn't use it as evidence.
I'm busy at the moment but when I have a minute I will go over your posts again and see where we are with this.
No doubt some of our more experienced mates are watching and will also give input.

I was reading and been following your thread, and must say, the information on it is valuable and indeed very helpful.
I have been following it till now, where I am a little stuck with Barclays.
After sending them all the who-ha's about prove-it, and requests for original documents, they also seems to have no original documents, I've been sending them also letters of default, etc.
I gave them 28 days to reply almost 2 months ago, was quite happy until today where I received a letter from them back-dated to the 22 of March still saying something like "sorry cannot provide you with the true agreement under s77/78 of CCA 1974".
I kept the envelope and scanned it which is dated today.
Is it possibe to advice on what to do next ? (i.e. ignore the whole thing totally since they cannot provide the signed agreement), or (write something back to them saying "the aledged debt is now statute barred" and also refer to the naughty back-dated letter?
They only been sending me a printed-letter-head with the aledged agreement but still no true copy?
Shall I start a cort-order request?, if so, it would be helpful to know how it's made (letter format/protocol/etc).

Hi Haydoor, We need a little more information as to whether or not your debt would qualify as Statute Barred. i.e Have you gone 6 years without acknowledging the Debt and was the original credit agreement before 2007?
This thread is one of several relating to the activities of Aktiv Krapitall.
I have a feeling that if you repost on Debt Free Wannabee there will be plenty there who will advise you.
All I will say at this moment is until they produce a true signed copy, there is little they can do.

My other half called them last night purely to tell them to stop calling. We will be following up with a letter, but i think we may have to send it email now, as our son decided to break the printer! They said over the phone they are unable to get the full statement of account from Barclaycard, not suprised as for those dates its now over 6 years ago! BUT it wasnt until recently when other half had stopped paying them that they sent a statement, (1st one in the how ever many years we had been paying) to which there was a 17 odd % interest charge being added, so the balance was actually more then when we started! Its all a complete farse.
