    If it's of any comfort to you I've previously ignored letters threatening visits from field agents but no one has ever turned up at my home. If you read the letters carefully, they all say they may send somebody, not that they will, it's all in the detail ;)

    Hi Guys

    My wife received a letter from Aktive Kapital advising her that she owes them approx £600, she did the normal thing (because the letter looks quite scary!) and rang them immediately to see what it was about. Apparently it is a debt with Kwik Fit from 1999?! She cant ever recall anything being taken out with Kwik Fit so unsure what this is all about. Needless to say she has denied all knowledge of this and even asked for proof of this because she doesnt know anything about it.

    After she rang them she rang me about it and having searched google (and having found this thread as a result) I'm starting to wonder if she did the right thing by ringing them....I get the impression she should of perhaps ignored the letter because she genuinely doesn't know anything about it?

    We both have a clean as a whistle credit history and I did a search yesterday just to make sure there wasn't anything untoward on there relating to Aktive Kapital / KwikFit and there isnt.

    Sooo......what do you guys recommend now? Do we ignore any future correspondence or do we send a letter?

    If we need to send a letter could someone advise me which one please....never had to deal with anything like this in the past!

    Edit - Oh forgot to mention that AK offered to reduce the 'debt' to £250 if we paid it now
    Another edit - They wrote to her using her maiden name, if we have to send a letter does she sign it in her maiden name or married name?

    Never a good idea to phone a DCA.

    If no payment or written acknowledgement of debt has taken place since 1999, then the debt is well and truly statute barred.

    It's worth sending them the Statute Barred letter (do not sign this, and send it recorded delivery) - it's then up to AK to prove it's not Statute Barred.

    They, on the other hand, hope you know no better, and will try to tell you that it's your job to prove that it is.

    Whch would mean that neither of you would have anything to lose by putting this behind you. They can't register a default now - especially if it's so old, that in a sense, it's done two rounds of Statute Barring.

    You could do either. If you want to do the letter route, then the Statute Barred letter is the way to go. I don't have a direct link to it myself, but it shouldn't be difficult to find, and some kind hearted soul may be able to link you directly to one.

    If they're offering a reduction, especially by that much, that means they know perfectly well that the 'debt' is totally unenforceable - if you knew 100% a debt could be legally enforced, would you accept a deduction?

    Also, never, ever provide any kind of signature to a DCA - some DCAs have been known to be 'creative' with signatures, that suddenly appear on paperwork never seen before by the 'signer'.

    Just wanted to advise you that we've had a letter back today advising that the case is closed blah blah blah.

    Needless to say we have scanned the letter and copied it a few times for our records just in case AK pass it on to someone else.

    I have been receiving letters from Aktiv Kapital for the past 3 years all addressed to my maiden name. I have ignored them as I know it is a scam as I paid off all my debts in my maiden name 9 years ago. They have offered to reduce the debt on a number of occassions.
    Today however I have received another letter telling me they have passed it onto their field agent co-ordinator who will make arrangements to attend my premises. Now I am worried, what do I do.

    So now I have another letter from AK....I couldn't believe it when I opened it. They are practically begging now! So here goes:

    Dear (my maiden name!)

    We would like to offer you access to our new incentive programme called 'New Deal'...blah blah blah.
    I have two choices: I pay them £285.39 by 30 June 2011 and THEY PAY £1141.54 and will clear my account.
    Or I can choose from four other plans that require me to go onto their website to 'select which plan works' me.
    The letter then goes on to say 'it is important that you deal with your obligation as continued non-payment may result in your account being sent to a Debt Collection Agency'.

    My first thought is...how can I pay £285.39 and the account be clear after they have sent me other letters threatening to send someone to my house for collection of the debt. Very strange!
    Secondly, an incentive scheme to pay off a debt sounds particularly dodgy to me.
    Thirdly, I haven't 'dealt with my obligation' as I have ignored all letters they have sent me.
    Fourthly, I thought AK were a debt collection agency so how can they send my account to a debt collection agency?? confused!

    The debt, if it's owed, is at least 11 years old anyhow. Any ideas what to do next?? Thanks guys!:)
