    Not a problem Rog - i was trying (and failing) to say it sounded okay to get in contact with them, but the confirmation letter should state:
    the payment will be a full and final settlement of the account. This offer is made on the clear understanding that, if accepted, neither they or any associate company will take any other action to enforce or pursue this debt in any way whatsoever and that you will be released from any liability.

    I knew what i meant, but wasn't quite what i was saying - thanks Rog.
    After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

  • I have just received a letter today from Aktiv Kapital (UK) Ltd dated 11/08/09 claiming I owe £13,826.18 on an outstanding balance with Barclays Bank Plc !!!????!!!

    Firstly, in their letter they've spelt my name wrong. Secondly, I've never had an account with Barclays Bank and thirdly when I phoned them they asked me if my partner was a girl's name I'd never heard of!!!

    They then started to ask me various questions to prove the debt WASN'T mine e.g. by asking for my DOB which I refused to give (...I am wary of even giving this as I occasionally receive suspicious phishing calls).

    I've now sent them an e-mail using the template someone advised below and hope this will close the matter. Just to clarify, I don't have a debt of £1.00 with Barclays let alone £13,826.18 ....these companies are a complete & utter joke

    The onus of 'proof' is, legally on the Debt Collector.

    They sound as if they are, yet again, in breach of the OFT Debt Collection Guidelines, by not ensuring that the person they are pursuing is the actual debtor:

    At the very least they should not even begin to discuss any 'debt' without first asking the necessary security questions, which you are not obliged to answer.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

  • I am being harrassed by Aktiv Kapital claiming I owe visa card £2100.00 they this is outstanding since 2001 the addresses they hold previousley i have never lived at and they are demanding 50% of this money within 14 days and the rest within 3 months there is no way I can raise this money what can i do.

    You could write to them and send the 'prove it' letter that's on the board and state that you did not live at the addresses they have mentioned . Might also be worth checking you credit file to see if they've put the debt on that - free at experian if you cancel within 30 days.

    If no payments have been made in the last 6 years, the debt will also be statute barred.

    Just thought you'd like to know that if AK don't get any response from you they pass you on to another company called CCS Collect (ccscollect.co.uk) - very unprofessional website that doesn't even work unless you presumably use IE (I'm on a Mac so can't see it at all!)

    Think it's probably time I sent one of those letters otherwise I can see this continuing forever and a day! :rolleyes:

    Didn't know where to post this but needed some advice
    I received a letter from Aktiv Capital on Saturday they are advising I owe GE Capital Time Retail Finance £253.59, not sure exactly what this is for and when from. Did buy something from Comet/Currys years ago but was under the impression this was all paid off.

    What is the best thing to do next?

    Any replies would be much appreciated.

    Hi, uniqa and welcome to DFW.

    The first thing you need to do is to ask AK for full details of the 'debt' as, from what you say, this 'debt' - even if it does exist - is probably unenforceable anyway.
