Does it? The way I read it they want me to confirm that it is my address! If, for example I had moved then I would leave a forwarding address or arrange to collect any mail mistakenly sent to the wrong address!0 -

I was taking it more from the posters point that they could send you a letter if they wanted to - didn't think it from their perspective that they may be testing the waters.
We usually advise people not to phone as they may start to get 30 calls a day from some of these companies. He tried to call but didnt get through. After reading your responses here, i have told him not to try again, but to wait and see if they send further correspondance.

I don't mind getting phone calls - they don't usually like me after a while since it is a complete waste of their money (I like to put them on hold for up to 10 mins and waste as much of their time as possible)
Unfortunately for them, I can't release personal information over the phone due to phising scams (this includes but is not limited to - Full name, date of birth, address etc...) especially since I have no proof that I owe them money or have ever heard of them until yesterday!
Edit: I am not advising anyone to do the same as me... Its probably better NOT to call them!0 -
This is standard AK talk for 'Phone us so that we can scare the !!!!!! out of you and get you to admit to a 'debt' that is probably non-existant or, at best, unenforceable, and reach for your debit card before you've had time to seek advice'.
Do NOT phone them. If what they wish to 'talk to you about' is so important, they can put it in a letter.0 -
Benson, when they said they have no legal requirement to provide a copy of the CCA, did they actually put this in writing? I have already replied to your question above but have remembered they actually last sent me a statement of account on the 15th of january 2007 for the previous 12months (no statement before and non since) but i am a bit puzzled by it as this debt as always been paid by standing order yet it shows that one of the payments recieved was for cash?. Are they legally required to send a statement every 12mths or not.0 -
i have also written to the debt collection company i already pay (TBI) and asked them for a copy of the original CCA, using one of the template letters as i have in the past asked for a statement of account only to be told they have no legal requirement to send me one. I have sent the letter by registered mail and will wait to see if they reply within the 12 days if not i will send the second letter informing them of their legal requirements
The Consumer Credit Act, 1974, is quite specific in that it places a 'Legal Obligation' to provide a true and compliant copy of the original executed cca on the person who is pursuing you for payment "whether they are the original lender or not".
If they do not reply within the legally prescribed 12 working days, then send them the 12+2 day letter, as you say.
If, after this time, ANY other dca attempts to 'collect' this 'debt', then send that dca a copy of the 'FORMAL NOTICE - ACCOUNT IN DISPUTE' letter from post 7 of http://forums.moneysavingexpert.com/showthread.html?t=063087I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
