    The first thing you will need to do is to check whether they are actually telling the truth or not. You should be able to check whether there is a CCJ listed againsy you from the registrytrust website. You may need to pay a fee to check though.

    Are you still living abroad?
    If so then you may not have anything to worry about.

    Did they state which creditor the debt was for?
    You may be able to send the "prove it" letter and get the details to see if the debt is actually yours.

  • Thanks for that George, no I am now back resident in the Uk.

    I will check with my credit record, but I think there is something showing on it as I have been asked about this debt a couple of times recently when I have applied for credit. But I don't know what exactly has been registered.

    I have always explained that I knew nothing about it, and as my credit record has been exemplary for all my life (and I am now 52) I've not had a problem with it so far.

    They advised that the debt was owed to Debenhams PLC.

    The original creditor would probably be required to keep a note of all transactions for tax purposes. I would have written a letter of complaint at the time.     Thanks George, I haven't made any payments (as it was cleared) or had any written contact with them for 6 years, I think I'll send them a statute barred letter, but use my old address, as I know any letters from them will get forwarded to my new address.

    I just can't understand why they try to collect so-called debt when they know it would be statute barred anyway. Makes me mad!

    I need some help as I have received a letter from buchananclark + wells saying I owe nearly £5000 on a credit card and they are acting on behalf of Aktiv Kapital. I have never had a credit card with the company they say and I have also looked at my credit file and they have put a default notice on it for this debt. They have given a legal notification that they are preparing an Issue of a claim in the local court.

    What letter do I send them and how do I get this removed from my credit report. I am so infuriated at this that they can just do this and the effect it has on me especially as it is not my debt. :mad:

    Any help would be appreciated.

    First thing you should do is phone the credit reference agency and inform them that this is not your debt. They should put a note against the account so that anyone doing a credit search will have this flagged up for them.

    If you are sure this is not your debt, you should write a letter of complaint to BCW stating that they are in breach of the Data Protection Act as they have placed a default on your credit file for an account that is not yours. They have 14 days to remove this before you inform the Information Commissioners Office of this breach - if the default has not been removed, write to the ICO stating what has happened.

    Stuinn, Aktiv Kapital are debt collectors so they may have bought the debt off someone else. If it's possible that you owe a debt, it might be better sending the "prove it" letter. If you know there isn't an outstanding credit card in your name, then give em hell.

  • Can anyone assist me,,,,,, I have just received a letter from Activ Kapital(uk) Part of the Activ Kapital ASA (Norway group) stating that "your account with us" claiming they have an outstanding balance for £1,600 with GE Capital Bank (Debenhams Store Card) asking me to call them and offering:
    • 50% off if payment is made by the end of the month
    • Pay £1.002.59 which is 60% of balance over 3mths
    I rang them and asked what this was in relation to and he stated it was for an account with Debenhams back in 2002/3. I asked for proof of this account and was advised that I would need to write in and request it then he asked me if I wanted the original application form which I signed.. so I answered Yes..

    Having read back through some of the feeds would I be correct in assuming they are scammers?
    Can you advice me on the correct way to deal with these sharks

    They're not scammers, they just don't make you aware of your rights.

    Did you have a Debenhams card that had an outstanding balance?
    If so, when was the last time you made a payment towards the debt?
    If you have made no payment towards the debt for 6 years, then the debt mat be statute barred.

    It's usually better not to phone them as they sometimes call non-stop once they get your number. If you do write to them, state at the top of the letter that you "do not acknowledge any debt" to them.

    OK now for the letter should I used the template that has popped up several times on here?
    I have also checked my credit report and there is nothing on there regarding this outstanding debt no CCJ's nothing...
