    I don't want to give this company anymore money than I have to.

    And niether should you. AK probably 'bought' the debt for a fraction of its original value and have, no doubt, already earnt a more than healthy profit out of you.
    As George says, get a Subject Access Request in as quick as possible.

    First off sorry if this is the same old thing that you have heard before on this thread but wanted to make sure I did the correct thing.

    Just read through most of this thread much thanks for the advice.

    In August AK wrote to me saying that I owed a balance of 2K to barclaycard. I ignored this as A) the name on the top was wronge and B) I have not had a barclaycard now for well over 8-10 years.

    I checked my credit file with experian and there was not debt in my name to barclays at this point. I printed this out incase for future reference.

    I then received the usual letters stating pay this now and we will reduce it to blar blar blar. In each 3 leters they still got my name wronge.

    Then I recieved a DEMAND letter from "Credit Security Ltd" demanding the debt be paid at which point I then looked for some advice on the web. I was told to send a letter to AK asking for an ORIGINAL statement of account showing how the figure where worked out. I stated at the top of the letter that I had no record of this debt with barclays. I asked them to supply the statement within 28 days or I would make a formal complaint.

    I then recieved 3 days later a letter from AK saying "statement of your account" now this was on there paper and thats it showing the 2k figure with an opening balance date of 01/10/2008 and an yearly interest figure. It also for the first time stated an "original agreement number" which I noted was only 13 digits long I thought credit cards where 16.

    I then recieved 1 day later from credit security a leter stating legal document where being prepared at a cost to me and to send a payment IMMEDIATELY.

    I then sent another letter to them today stating "I reiterate I have no record of this debt with barclays and I have yet to recieve an original statement of account" blar blar. I stated that if I did not recieve it by the due date I would be making a formal complaint.

    I then typed "who is aktiv kapital" into google and found this thread I wish I had found it before so this brings me to what to do now....

    I have not had an barclays card now as stated for over 8 years and not payed nor received information from them for over 8 years.

    Do I send the CC 12+2 letter?
    or do I send the 6 year old letter (sorry could not rem what you guys called it)

    If it was yours, then it would be statute barred.

    But you say they are writing to the name of someone else? Are they still doing that?

    The name they are writting to, first and last part is my name but the middle name is wronge and yes they are even after me writting to them are still using this name.

  • I have received a letter from Activ Kapital saying we owe them 4500. Have no idea what they are talking about and they even have our names mixed up my hubbys's first name,my initial and wrong spelling of surname.Is this a SCAM, someone please advise.

    They could be 'phishing' - contacting everybody with a similar name in the hope of 'netting' the actual debtor.
    Do NOT phone them. Instead, send them the 'Prove It' letter that you will find on post 2 of the following thread:

    To be honest I would just ignore it. I know for some people this would be a source of worry, and it was for me in the early stages of receiving these letters. I feared they would carry out their threat of sending people round but despite having now received a dozen or more of these letters over the last couple of years I've yet to have anyone turn up on my doorstep.

    I think they rely on scaring people into contacting them so they then have a positive target to attack. As rog2 says, the worst thing you can do is to phone them as they've got you then and will twist anything you say into accepting the debt is yours and getting money from you.

    If you seriously believe the debt is yours and you are legally liable for it then follow the advice above about sending appropriate letters.

  • I have now had an appology letter from them stating that it was an error in there records and that I would not hear from them again.

    These 'people' know that they are chasing debts which are legally unenforceable - they rely on the fact that 99% of those they chase do not know this, and will simply and quietly yield to their threats and 'pay up'.

    They 'play the odds', bones, and in the odd case, such as yours, where the debtor actually questions their right to collect or 'pursue', they will, often grudgingly, back down.

    Still, the most important thing for you is the result - well done.

  • Hi there.. Just wanted to update you that I have beaten Aktiv Kapital & Credit Security.
    With reference to my previous posts (page 54 post 1071) this has been on going with ignored Statute Barred letters to Aktiv Kapital, with greatly reduced offers from them from £1,600 bill to a reduced offer of pay only £450 by end of the month to them finally passing the account onto Credit Security Debt Collection for "court action" even though there has never been any CCJ or other contact from GE Bank (Debenhams) since 2003... Sent a Statute Barred letter to Credit Security Limited (with the copy of letter I sent to Aktiv Kapital back in Oct) and threatened them with OFT complaint.
    Got a letter from A K 2days ago saying " Account is Statute Barred and No further action to be taken" and statement of account showing ZERO...

    Thanks to you for all your advice and guidance and just wanted to give hope to others.... keep fighting these B*****ds..
