    Can I just add to the post of 10past6, do not sign your letter, as these companies have a habit of forging your signature.

  • Hi not sure if someone has already asked this, but i'm stressed and can't read though everything properly!

    I had a letter a few months back from Response Credit Management on behalf of Akitiv Kapital. It was sent to my parents address and they didn't even get the second initial right, thats why my mum opened it!
    I panicked and rang them and told them it was not me or her. They apologised and said the debt was from a store card bill in 1999. I rang from my mobile and withheld my number. I thought that would be the end of it. Any way on Friday an answer machine message is left on their house phone with a reference number and contact for a Ms ********* to ring them. It was from the same company again. What do I do? This isn't my debt! I'm getting stressed by it now as anything to do with money worries me. What letter should i send to them, as now i have read the messages here I was a bit daft to ring them, but I thought it was sorted. As you can imagine, my parents don't need this stress either!

    Don't phone them, keep everything in writing, the onus is on THEM to prove the debt, in the meantime, send them the following letter by recorded delivery:

    Dear Sir/Madam

    Account no:

Do I need to put that I have rang them a couple of months ago and that i'm contacting them by letter as they have rang my parents house? or do I just leave it?

    You can inform them you've requested telephone details be removed, also include this letter:

    Dear Sirs

    Harassment by telephone

    Account Number: XXXXXXX

    I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

    I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)

    I now require all further correspondence from your company to be made in writing only.

    I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

    Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

    I request confirmation that my telephone details have beem removed from your databases.

    I've read through the heaps of useful advice in thread re Aktiv Kaptial, so thank you very much for the help.

    I have one question. I've received a letter from Buchanan Clark + Wells acting on behalf of pursuers Aktiv Kapital. I've seen the letter templates on previous posts but I'm unsure exactly who I should post them to. Should it be Aktiv Kapital, Buchanan Clark or both of them?

    You should post the letters to whoever is actively pursuing you for payment.

    After a 6mth silence from AK I am now receiving more letters!!! :rolleyes:

    Looks like they have changed tactics as well as the layout and content of their letters to appear more 'professional' :rotfl:

    They are now offering me a 'substantial reduction' in exchange for a one off payment to them as they are concerned at my complete lack of contact with them! *sniggers* :D

    Off to the shredder we go .....
