Aktiv Kapital (UK) - Who Are They?
Comments
-
i have received several letters from Aktiv Kapital, in an attempt to find out once and for all what they were after me for I caleld them today.
The debt is for a bank account (Barclays) which I had a few years ago (7 at least) whn I lived down in Devon. They said the debt was passed to them on the 16th February, I remember having the bank account but I remember closing it in good-standing.
I am not sure which letter I should be sneding to them and also unsure how to proceed after this, I am moving in a couple of weeks and am having to get my mail redirected, they said they had been able to track me down, I had to give them 4 address (inclusive of the old one) before they told me what address it was, but they had not written to me @ any other address.
I would like to send the letter tomorrow so as to get it onthe way before the bank holiday weekend, so if anyone can give me any tips etc. they would be welcomed.

This was resolved, or so I thought, I told them that I did not owe the debt and asked for proof that the money was owed which they could not come up with.
Anyway 2 days ago a received another letter after not hearing anything from them since 2007, I have decided that unless they start sending 1 letter a week again then it's not worth my time and effort to tell them again that I don't owe the money.
If I do start to receive regular letters would it class as harassment and be enough cause for my to see my solicitor?0 -

If there was no reference to any actual 'debt' on the letter, I would be inclined to ignore this particular letter.
However, if they send another letter, then report them to Trading Standards - no need for solicitors' fees at this stage.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I had a letter from Aktiv kapital on saturday adressed to my maiden name about a Barclays debt which I know I dont owe.
I had a Barclays account from the age of 15 to 18 and then I moved to the halifax when I went to uni.
Wouldnt mind but I'm 32 now so it's been a while :rotfl:0 -

There are a couple of options open to you, melanie:- You could send them the 'Prove It' letter that you will find in post 3 of the following thread: http://forums.moneysavingexpert.com/showthread.html?t=963087 This is, usually, a good first letter as there is no fee and AK are obliged to tell you what the debt is, under the 'Guidelines on Debt Collection' as laid down by the Office of Fair Trading: www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft664.pdf Once you receive an answer, you can, then request your cca, if, indeed, that is the most suitable course of action.
- For an overview on requesting your cca, plus a template letter, have a look at: www.nationaldebtline.co.uk/england_wales/factsheet.php?page=getting_a_copy_of_your_credit_agreement_and_account_details
So send off the 'Prove It' letter, then post again, depending on their answer.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

Thanks roq2
well I have been paying it off for a while now, first £50 a month then I couldnt afford it and went down to £30 a month. I though it must have been for an old bank account that I had roughly about 4 years ago.
But then I googled the company and came across this site here, and noticed they never ever state what the debt is for.
So I am just gonna stop paying thme for now and find out what the debt is actually for and then start paying again if they can provide the info.
Hope that is alright to do.0 -

Okay, melanie - you need to be aware that 'overdrafts' are not covered by the terms of the Consumer Credit Act, so if this 'debt' refers to an old overdraft, then the 'cca request' will not be applicable. On the other hand, if it referes to a 'loan' agreement or credit card, then yes the cca will be applicable.
So, best bet is to send the 'prove It' letter, first. :beer:I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

Well it actually could have been a credit card...the HSBC Bank gave me an overdraft after 6 months and a credit card, young and stupid as I was I obviously used it to the limit...
But as I said before I have no idea what it is, and am gonna sent the 'prove it' letter off in the next couple off weeks, especially now they started to call me the last few days trying to get me to increase my payments, which I cant afford at the moment...0 -
Hi All, this is my first post in this thread
We have been one of the lucky ones to receive some lovely correspondance from Wescot Credit Services in the form of a 'Debt Notification' for the sum of £165.99.
After a phone call, they confirmed that the debt was for Kays Catalogue from 2001! We have never purchased anything from Kays! When we phoned them, we were totally unaware of this comapny's dodgy reputation, and we were truly puzzled about the debt, and thought we had been the victim of some sort of identity theft. The advisor at Wescot said we needed to prove our residence in this house (where the letter was sent to) because the account opener of this debt has resided in Oldham, Yorkshire - somewhere we have never lived! He said we would need to send them council tax correspondance to prove we have lived in this address (West Mids) and not Yorkshire.
I have since read that they need to prove the debt to us, and it is irrelevant and unenforceable anyway as the debt is over 6 years old.
Rather than getting into any more phone conversations with them, or sending them unnecessary personal details, do you suggest we send them on of the statute barred letter templates and see what happens?
Thanks in advance.0
