Aktiv Kapital (UK) - Who Are They?
Comments
-
Hi
I have just discovered defaults in my name from September 2004 on my credit file at an address I left in June 2004. I left this address to live abroad and have only just returned to the UK. I have recently been declined a mortgage which is how I came accros them.
I have contacted the credit reference agencies to try and understand what these are and they have directed me to Aktiv Kapital saying I need to call them with a couple of references.
I absolutely dispute that this debt is mine as I have never taken any credit agreement at this address. I did have my passport stolen when I lived here and wonder if this is how credit of over 2000 has been taken out in my name.
I am really very worried about how to get this removed from my credit file as reading this forum I understand Aktiv Kapital to be unhelpfull. I do not wish to acknowledge the debt as I believe it is fraudulent.
Can anyone give me any advice?
Thanks so much

AK are legally obliged to tell you what the defaults relate to, and to 'prove' that the 'debts' are indeed yours.
I would write to AK (do NOT telephone them' sending them an amended copy of the NDL 'Prove It' letter that you will find in post 3 of the following thread:
http://forums.moneysavingexpert.com/showthread.html?t=963087
If, on receiving their reply, you still believe that these debts are fraudulent, then go first to the Police, and post again here, before you contact AK again.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Hi,
I'm very concerned, I've just received a letter from Aktiv Kapital telling me that they've been trying to contact me at a previous address, and have now been informed that I no longer live there, but at my current address..
Now for the fun bit..
I moved into this house 3 months after my 18th birthday, accruing no debt in that time! That was 21 years ago. My name is different now having divorced and re-married since. This letter is in my new married name, so how can they have been trying to contact me at a previous residence with THIS name? I don't know if i should get in touch with them or ignore the letter?

Well that takes the biscuit. I think the oldest statute barred debt we have seen previous was about 17 years.
Even if there is a CCJ, they would need and be refused court permission to chase you for it.
Wait until they tell you what it is about. If you've have not made a mistake, you've made nothing0 -
Thankyou so much,
I've just remembered that I never got round to cancelling my "free" credit expert account so went and checked my report, there is nothing whatsoever on there to say i've defaulted on anything, no black marks against my name at all.
So i'll wait to see if they contact me again.

but the point is my name was different then, (my first married name, then my maiden name, i've only had the name that the letter is using for the last 5 years) and i've never lived anywhere else since being eligible for credit, and they're trying to say they're chasing a debt from when I was at a different address (although they dont tell me what debt or what address) Either - giving them the benefit of the doubt - they're chasing someone with a similar name to mine and assume i'm that person, or they're totally fishing and chasing a debt which has never existed.
Is the onus on me to prove this isn't my debt, or theirs to prove that it is?

I am so frustrated with these chancers Aktiv Kapital. They initially wrote to me approximately 6 months ago, chasing me for some debt I has never heard off. Luckily I found this site and sent off all the letters. They never got back to me with any 'proof' of this so-called debt until after the +30 letter day had been sent (this was before the law was amended), so i forgot all about it. When they did send something it was some screen shots of something, i couldn't even see my name or an account number on. I fired off another letter saying they had failed to supply details etc etc and heard nothing for weeks. Basically this repeats itself every few weeks, they send cards saying someone will be calling round (they never do), or I need to call them urgently or further action will be taken! I am now just ignoring them as I cannot be bothered to waste the stamps. However, I have just recieved a letter from them to advise that Aktiv Kapital Asset Investment Ltd have taken over the interest of GE Capital Something under some debt I owe them!! They advise me to call them to discuss this accoun urgently, as though there has been no previous correspondence!!!! I notice that the PO Box address has now change d to Chester, whereas it was Edinburgh I believe before.

in this instance I think the best option is to report them and CC them into the correspondence.
1. the trading standard nearest their offices (do both)
2. the OFT
3, contact you MP
And make a formal complaint preferably to their CEO.If you've have not made a mistake, you've made nothing0
