eBay has a responsibility to stop anything illegal being sold on it's site, however links are not illegal.
Although very unethical, if you bid and pay for one of these items, you are getting exactly what the auction was stating... all be it a link.
Whilst I don't agree what these people are doing, they've just playing the stupid people for their money, and to be honest if you're not going to read the small print on anything then more for you.
PayPal, eBay and your credit card company will wash their hands if you try to dispute it, as they have no grounds to dispute it, as you got for what you bid on.
Just feel sorry for anyone who has actually paid for any of these.Smile... it's free0 -
Illegal = is anything not legal. legality is set down by the courts.
eBay cannot make anything illegal, however they can not allow people to sell certain things through their medium.
I.e if someone was selling Class A drugs on eBay, they would be jointly liable in the courts, however if someone sold a link, as long as the person got their link there is nothing the law can do, however it is against their policy.Smile... it's free0 -

with regards to a refund for the link you recived, you can dispute the auction thru paypal and in most cases they refund payments accidentally made on link auctions.0 -

I think you may be mistaken on this. I have never come across an incidence where a payment has been refunded because someone bought a link. It is also not possible to 'accidentally' buy a link, the bidder would have had to confirm on two screens before his bid was placed, nothing accidental about that.
Luckily though I think the oP in this case asked the question here before he bid.

You probably could through paypal or at least worth a shot, since the seller would have to prove that he provided the service through trackable means. How would he do that? He emails you the link, he can show proof he sent it but he cant show proof that you have received it.... no trackable means for the seller. One loophole there!0 -

I personally know someone who has paid £200 for an ipod off ebay, it wasn't until the item arrived the item was actually a CD with links on where to buy one. The links didn't work. When he comlained the seller gave him a £100 refund.
I checked the auction and it was in the small print, that had not been carefully scanned by the buyer. Not much I can say to him as he's got the CD as listed in the auction. He may try the angle that the item isn't as described as the links on the CD don't work.:idea:I got an idea, an idea so smart my head would explode if I even began to know what I was talking about:idea:0 -

If I read your example correctly it appears that the seller gave the refund without involving paypal, so it doesn't act as a precedent for paypal refunding money on a chargeback claim.
It is always good to hear of a links seller with a conscience.
