As you've already said, it is your hard earned cash ebay/paypal won't protect you if it is faulty. You're better off pre-ordering from major outlet where you're normal statutory rights apply. As its a new gadget, there's bound to be some teething problems. Maybe after the Christmas rush, the price will drop off a little or better bundles can be had.

As much as I would like one, I'd rather wait and pay my money to someone I can go to when it goes wrong. If you also pay on a credit card, they too can also be held liable.

trace-j, if you look back at the OP the auction was only for a link and has very little to do with an actual item. I don't know of any statutory protection on ebay or elsewhere that covers the selling on a link. As others have said though actually selling links is against ebay terms and conditions and should be reported to them.

Can you not get a refund as it is an illegal item? If ebay were serious about not wanting these listings, that would be a very good way of stopping them.

No I don't believe it is possible to get a refund purely because the item wasn't allowed on ebay in the first place. I think that bidders do need to be more aware of what they are doing, if bidders stopped falling for these scam artists then they would soon go out of business.

Thats incredible! I can't believe people are actually allowed to sell non-physical goods and get away with it whilst only stating once at the end of description. Otherwise ebay should make listings of such types in a new category called 'links only' so that things are more clearly defined and new buyers are not so easily sucked in. This is not good and I think ebay would look at fault if it became a court issue as it is their site and if they can't regulate it properly to protect innocent buyers, then it looks even worse for them.

These links are not allowed on ebay and if people report them they are often removed but unfortunately not in a timely fashion. However, as I said earlier surely the buyers need to take some responsibility? They are prepared to buy from a seller with poor feedback and with existing negs for selling links. There is no post and packing quoted, so that should raise a question or two about how a PSP can be sent 'free' and finally it does say this is a link. How many people honestly bid over a hundred pounds without reading the full description?

No paypal will not refund the money as the buyer bid on a link and got a link. However, the buyer might feel aggrieved enough to make a fraudulent claim for non receipt of course.

Good move! this should help people see this person is a fraudster!

Only thing is that the summary doesn't make sense on my screen tho, it still says:
    Feedback Score: 2
    Positive Feedback: 100%

Members who left a positive: 2
Members who left a negative: 0

    All positive feedback received: 2

Yet s/he only has 1 pos feedback and 2 negs????

3 feedback left by danceclass4 (0 mutually withdrawn)

They'll probably still be people bidding, they were already bidding when there were two negatives, some buyers only see what they want to see unfortunately.
