He said that I have to go to the station in a month but he may ring me beforehand. I asked him if he thought it would turn out alright and he said he thought it would. As I said earlier the police were very nice in the end and he said he had never arrested anyone for using coupons before. I just want it over with. I don't know what to say to make you all believe me and I don't want to put the number on here in case it messes anything up. I will say that the charge thing looked like the label I get for proof of postage from the post office!

    flowerclipper, I'd name and shame the store if that had happened to me and would have contacted the local papers. The manager would be sacked because Sainsburys wouldn't want that sort of publicity.
    Let us know the store, you'll have lots of support from people on this site.
    It won't stop me using Moc's I'd just rummage for my glasses in my bag and say which Moc do you mean dear.

    Unlucky, I reckon your going to the slammer. You could be facing a stretch of 6-8 months although good behaviour and not using moc's at the prison shop may get you out in 3-4 months time.

    So the manager interviewed you in between the point the police arrested you and the point the police read you your rights?

    That doesn't sound right - the police should read you your rights at the exact moment that you are arrested, not 10 or 20 minutes later, otherwise it's not a lawful arrest. This is extremely basic police training college stuff, and I'd expect every copper in the land to be aware of it.

    A member of the public, like a store manager, isn't allowed to "interview" you or interfere with the matter in any way after the point you've been arrested.

    Under the Bail Act 1976 and Police And Criminal Evidence Act 1984, police officers don't have the power to bail you if you haven't been taken to the police station - only the custody officer within the police station is allowed to make a decision like that.

    Either you're talking poppycock or the police have made a string of outrageous and grave errors, in which case I'd make a complaint to the IPCC and see a solicitor pronto.

    Flowerclipper: you used your coupon at a till that was manned by a cashier, so the cashier readily took it as payment. If she/he took it as payment, then did you not ask 'what crime have I committed: your cashier took the payment'. Surely if it was theft/fraud then the cashier should have been arrested too, as she/he would have been party to it?

    What did you buy? How much?

    What coupons did you use? How much?

    I'll reserve judgement over your story but I'm leaning towards Taxiphil.

    I have always loved the antics of Duder and Taxiphil - never thought I would get slated by them! Was taken from the coffee shop. Asked to sit down. The manager asked me if I had used a coupon and then said I could lie or tell the truth. Told the truth and said I had. Then the male officer held up the coupon and said that I was being arrested for fraud and deception (it only says deception on the sheet) and then he sat down and interviewed me. As time went on both police officers became very pleasant. They took remaining coupons in my bag. When they left, one of the police told the manager that they were going off to look after people who were in custody. The police officer who arrested me said he thought it would be alright. Just want it to be. By the way, I am not a new MSE'r. Couldn't log in under my previous username so as was desperate for advice re-registered. Have just looked at the piece of paper and there isn't a number but it says it was done under the 30a Police And Criminal Evidence Act 1984. I suppose this is because I was arrested but as yet not charged.
