if you've made the decision to go bankrupt, and will be getting a court date soon, then I would suggest it's not worth making any more payments - use the money instead for your BR fees. That assumes your court date is soon, if a few months time, you might like to consider nominal payments to creditors to keep them at bay.

I will see what H finds out tomorrow about court dates. I don't really want creditors starting to ring cos unfortunately the DDs are at the age where they answer the phone now and I wouldn't want them upset by it all :(

Or just get your phone number changed, its easier than trying to keep creditors at bay as it can take more than a few months to get them to agree to min paments and then they still hound you:confused:

Now that's an idea - thank you!

Hi direstraites (cool name btw )

No unfotunately things have been pretty bad for some time now, and the money situation has only exacerbated things. Talking about the money situation only really came about because he and I have been discussing the state of our relationship, and whether it's salvageable. Up until then he, and I, had our heads concreted into the ground about how much we owed :o:o:o

There is no lack of love, but a distinct lack of compatability about even the smallest things it seems. :(

Just re-read that and it makes zero sense!! Basically, my money went on the family, his money went on him. I knew where I was financially and that I was starting to struggle.

The disparity in our attitudes towards spending our money was part of the reason for the relationship breakdown. It's only now that I have seen the full scope of his debt, and obviously the knock on effect to me.

Hi, if you decide that your going to go BR, then i would stop all the payments to cc/loans and mortgage - your going to need some money for the BR fees and also rent and moving costs. Even tho its a friend of a friend sort of arrangment please remember you need to get in writiing the tenancy agreement, amount rent payable and if any water rates etc are included. At least this will helpprotect the new hoe for your kids, after all things will be changing quite a bit if you decide to go it alone.

Thankyou for replying, its nice to know that you can help help others with your experience - me and my OH seperated for a while due to our escalating debts, loss of home etc.... Were back together but things are hard at times.

Good Luck and lots of ((((hugs))))) as you sort your finances out

Hey Nutty, thanks for that. Tis too late to stop most of the DD payments for this month - payday finally came around  - but will definitely take that in hand for next month.

If we go down the renting from a friend route, it will be all official and above-board. No way do I want to risk (a) my kid's new home and (b) my friendship!!!!

Didn't sleep particularly well last night - feel like I have a poker stuffed down my neck as it's so stiff and unyielding. Am off work with S&D, which has the knock on effect of stopping my normal painkillers from working as they are not staying in my body :o:o (I have bad back problems), so think I am prone to feeling rather sorry for myself! No time for that - need to keep moving!

Sorry I'm rambling! Thanks again - this place is amazing for advice, support and just making you feel so much less alone :T

    Update:

    * no go on the renting from a friend.
    * H rang and spoke to Local County Court - it's by appointment and they have a two week waiting list. Panicked H cos they asked if they should book him in straight away

    Tomorrow:
    * Ring local estate agents and find out if they will accept undischarged BRs, how much they want, etc
    * Start filling in forms

    So that's the plan...
