    I would begin the process again with the Request for repayment of charges, followed by the Letter before action.
    The chances are that they will ask you not to persue your claim due to the OFT test case but do and while the claim might be stayed its better to start the process.

    Hi all, sorry if this is in the wrong section of the site or if this question has been asked many times before :o

    Last year Halifax charged me £130 for a transaction I made to Tesco when I was £11 short of funds :mad: The charges kept mounting whilst I was unaware as had chosen paperfree banking and didn't check my account much as it's a bit of a hassle logging into their online system. I didn't get any letters from them at all. Also I didn't think my card would have been accepted by Tesco if I hadn't had the available funds so had no reason to worry. I rarely used the card anyway as prefer my Barclays account.

    When I first found out I owed them money I paid them off the £50 odd they were asking for but a month or so later I checked my account again to find they were STILL charging me even though I had paid my debt! In the end I paid them the extra £80 to keep them off my back.

    Around this time the court case with FSA was due to be happening so when I contacted my local court they told me any claim would be stayed so it wasn't worth applying now. I'd have rather had the £80 odd it costs to file a dispute in my pocket anyway.

    I was wondering whether anyone knows if it's possible to file a claim now and when it will be heard? I could really do with that money back as I'm a student with no job at the moment (I am looking though) :(
  • Hi...I started a complaint against my bank last October after they took £250 from my £350 Incapacity Benefit. After lots of sorting through bank statements etc they decided I wasn't a hardship case as I have Sky TV (Naughty Me! I don't smoke, drink or go out socialising what else am I supposed to do when I am paralised and can't move!) I also contacted the Ombudsmen and they were as helpful as a chocolate teapot! The one woman I was dealing with was rude and also said I would have to get rid of Sky (are they obsessed) if I wanted to be classed as a hardship case.

    Now that the court case has been won what happens now?

    Do I need to send another letter to my bank/Ombudsmen as I am now stuck in a rut money wise as they have heaped on so much charges I am going to end up in more debt then ever.

    I need a template letter for kick starting the claim I already started...does anyone have any ideas?

    To clarify, the court case hasn't been won as such, please read Martin's article as to what to do next if you already have a claim in the system and don't assume that the bank will be in touch with you if you haven't been pursuing your claim.

    I lodged a claim for bank charges back in January 2007. As you can only claim for six years. My claim has already been lodge for one year, so do Indeed to submit a new claim going back six years from now. Or what happened to the last year of charges?

    Hi every body

    Need some help understanding next move with Bank Charges

    I have submitted a claim to Halifax for Bank charges.

    Had a leter back to virtually to say that until court case is dealt with nothing will happen however they have noted my claim and will keep me informed..............And don't bother contacting the courts because the will submit a stay.

    I'm confused.

    Do I now contact the FOS ?

    Put a claim through the courts ?

    Or wait for Halifax to contact me ?

    Hi, i did all the steps last year, but my claim got put on hold by my bank due to the test case etc, ive recently seen that people have put in for there claims, what letter etc do i send them now to continue my claim? and also since last years claim they have charged me 3/4 times up till now..

  • I am trying to reclaim bank charges incurred on a bank account that has been closed for a while. I sent an initial letter asking for the charges to be refunded, they refused saying that as my account has been closed for over 2 years there is nothing they can do. I sent a letter back (downloaded from here) giving them 14 days and I have now received a letter back saying their decision remains the same and are unable to refund charges. Not really sure what to do now. Any advice would be gratefully received.
