The best advice is to refer to the infomation on the FSA website. The judge was explicit in the ruling yesterday that even though the banks won two of the three of the points, this does not mean that the charges have been unfair. This will be resolved later and only then if the banks lose, is there any point wasting your time attempting to claim back charges, you will have to pay for your statements etc. The FSA waiver agreed that from the end of July last year the clock stops, so if the court (not OFT) decides the fees have been unfair you will be able to apply for whatever is then appropriate from after JULY 2001 (anything prior to that, you are too late. see http://www.moneymadeclear.fsa.gov.uk/news/product/unauthorised_overdraft_charges_test_case.html0

Please help....I have a claim which is caught up in court with a stay. This claim was for 6 years up to December 2007. Since then the bank has "blessed" me with further charges. Can I put in a claim for these now, or do I need to wait until the first claim has been sorted?0

i need help on this matter. back in 2000-2003 i was a student at university, as students do the banks provided me with overdraft and credit cards.
then when i went over the limit they started charging heavy and i couldnt make the meeting requirements which kept putting me back and back until i completely lost track on all these. the banks wouldnt help me under the circumstances to reduce payments, it lead to my accounts being transfered to the bailiffs.
to cut story short now i have CCJs and interest accumulated. I am really stuck as i owe around £10000 and i dont know wethher i can or where to start. last 4 years i have been depressed over this matter, and would like to know if there is a way i can get these looked into by courts or any other means now that i dont have bank or credit accounts with them?

Hello, Don't worry, you can still claim these charges back even though you don't have an account with them anymore. I have done it myself successfully even though my account was closed. In fact they even paid me more than I was claiming. Not sure where you would stand with the interest on the ccj's but you can claim the charges back from the bank plus the interest you would have earned on them charges.:j

Hi there people.
I recently tried to reclaim my bank charges. I sent off a cheque for a tenner asking for my charge sheet and i got back only a about 2 years worth of bank statements. The letter said that as there were alot of pages they were being sent in different envelopes. But all i got was a few sheets from 2002 and a few from 2003. Then the court case came around and i stupidly didn t follow it up as was waiting for a verdict.
Now that the verdict is looking good i ve got a couple of questions to ask people.
How far back can I claim my charges? I heard 6 years.
Is the fact that i have asked the bank for my bank statements but never received anything like a comprehensive breakdown of my charges enough for me to still be claiming from my original date of contact with them? Or will it only ever go from the date of the request for the money back?
I m asking as i know that around 2001 i had quite a few bank problems and was charged alot of money. I managed to sort that out so that by the end of 2002 my account was ok.
I also know there was another time that i was regularly charged by the bank to the extent that my account was closed but i never recieved info about this time in my original request either.
This is Lloyds btw.
Anyway. Any advice people can give would be really appreciated.

You should be able to claim back 6 years worth of charges. I have written two letters to the bank and had a reply from the second one saying everything was on hold and they would contact me awhen they know more. Obviously these letters were sent months ago, do i wait or do i resend my letters? Please can someone help!!!!!!!

In June 2007 I had reached the point in the reclaim process where I had sent my LBA letter and had received a standard letter in reply. The next stage was to issue a court claim.
I debated whether to issue the court claim, spoke to a solicitor but he didn’t really have any advice. A few things in my personal life happened and this was all put on hold. I’m now ready to carry on with the claim however,
Is there a certain amount of time to complete this process? i.e. if I sent the LBA June last year, can I still issue a court claim now? Or should I re-start process again?
I’m still incurring paid referrals – however my documentation only looks from July 2002 to June 2007. Will any further charges (after June 2007 to present day) be taking in consideration and also refunded?
Should I issue the court claim, or wait and see what happens in the test case?
If the banks lose, will they just refund charges as standard to all customers, or only to those that have issued a court claim?
Appreciate any advice0 -
A year or so ago I sent my bank the first two template letters but got 'brush off' letters in reply, this made me nervous as I'm a single mum on low income and I didn't proceed with it, what's the best coarse of action now?0

Hi all :wave: . Can someone help. My claim from early last year is on stay with HSBC pending the outcome of the court case.
I have now gotten my finances in order but since March 2007 to December 2007 I accumulated further charges £300 - can I make another claim for these?
