I sent of the forms to reclaim my bank charges about six months ago, but I havent heard any thing off them. Is this normal because of the court case?0

I had reach the final letter stage last June when the OFT case started the bank wrote to me to deny anything unfair in their charges.
At this point I wrote back stating that I did not accept this as an end to the matter and that I was aware of the OFT test case offering them the opportunity to exercise good customer relations and good will and settle or I would apply the interest in the event of them losing the test case.
So now they have lost the test case, I am planning on writing to them again requesting they settle and threatening them with small claims proceedings.
Is this the right way to go? are small claims courts accepting claims again?
Is there anything else I should be doing.0 -
You need to read Martin's article regarding what happens next and your choices.

Hi - I put in a charges reclaim with Barclays in July 2007; the response was that nothing would be considered until the court case was completed. Recently I've run up some more charges, and was wondering if I should submit a further claim in addition to the one pending, now, or what??I'm reading that some people have had movement on their claims recently, but I've heard nothing - what's the general experience with Barclays, and is it best to stay quiet or pester them?? Also, am I reading correctly that it's worked for some to chase reclaims over the phone rather than just deal with a written response? Thanks if you reply!0

Some people have had refunds of single charges over the phone. For a whole claim its best to stick to letters, although there is no harm in calling & asking them to settle, you've nothing to lose.
If you have already submitted your claim to court, it is too late, you'll have to either amend your claim (which costs money) or start another one. If you're still at the letter writing stage, then yes you can add the latest charges.0 -
I reclaimed 6 year's worth of charges from Barclays. I didn't chase them, they came to me just before our court date and offered me everything I was claiming plus my court and claim costs. It's very tempting to get on to the banks by phone to try and push them on but please resist it! If it's going to happen it will happen on its own!0

cheers for that - I hadn't gone down the court claims route, hoping to get something out of them by writing direct - do you not need to go through this process first, and then push to court if their response is unsatisfactory? Kessik - am wondering what their initial response was to you, if you did this?0

Hello, I wrote to my bank almost one year ago requesting they repay all charges. The bank wrote back about 5 weeks later saying they would not be able to repay them as they are fair charges and stated in the contract with the bank etc etc. Stupidly I decided to drop the demand. Now, however I want to continue the claim. Should I / Can I start again... or maybe I should just write another letter in continuation from where I left off. I already have the statements etc. Can someone please advise. many thanks Jeff0

I sent the template letters to my bank last year, i also paid £10 to have a copy of my charges sent to me. Do I have to send another letter to my bank again, now that the test case is over, or do i just wait to see if they contact me?0
