  • if we have already tried to claim but then been on hold because of the court case,if we win will we have to go through the bother of getting all our statements and working it all out and writing to them again or will the banks have our previous letters and sort it themselves anyone have any views/ideas?

    I doubt they will sort it themselves! can't see them just handing the money over!

  • Hi, can anyone help me? I had to go to court in feb this year ref these bank charges & they put a "stay" on the claim. With this latest news from the OFT, what should I do now? do I sit back & wait or should I get straight back onto the bank again? I had to pay 80.00 court fees, will I be able to reclaim that too?

    Hi all !

    First of all congrats to those who already won their battle !

    Now I need a little help....Late last year i downloaded the template letters provided on this site, wrote a hand written letter to halifax and then contacted the court before posting to get the lastest. The clerk stated the bank charges case was going to the high court and he stated that the court was taking aplications still and money, but the could not pass judgement until the high court case had been heard.
    This put me off and I still have the paper work.

    Now as of 24/4/2008 i see on the news that the courts have declared the charges as unlawful.........Am I to Late to apply through the courts and get my charges back?

  • i need help on this matter. back in 2000-2003 i was a student at university, as students do the banks provided me with overdraft and credit cards.

    then when i went over the limit they started charging heavy and i couldnt make the meeting requirements which kept putting me back and back until i completely lost track on all these. the banks wouldnt help me under the circumstances to reduce payments, it lead to my accounts being transfered to the bailiffs.

    to cut story short now i have CCJs and interest accumulated. I am really stuck as i owe around £10000 and i dont know wethher i can or where to start. last 4 years i have been depressed over this matter, and would like to know if there is a way i can get these looked into by courts or any other means now that i dont have bank or credit accounts with them?

    Please help.

    I reckon it will be end of the year before it all gets decided. And assuming the court finds in your favour, you will get the £80 back too. I was waiting for this initial judgement before submitting my papers, but I'm not expecting a positive outcome until its been dragged through the courts again.

    Dont ask me why I havent done anything about it before but I havent.

    Back in 2001/2002 I was young, stupid and ended up £1,500 over my £200 overdraft due to bank charges. My account was frozen and I paid it all back gradually.

    My question is, due to the time lapsed etc etc - do i have a leg to stand on?? - If not I understand totally my fault :) Just curious.

    Great news about the court decision :money:but I was just about to submit my small court claim (all completed and saved online) but don't know whether I should submit now and pay the £60 fee or wait until the whole issue is resolved in its entirety?<O:p</O:p

    The only thing that worries me is will it be likely that the banks get a decision that applies to all those claims lodged with the small claims before the 24/04/08 decision (or the later final OFT date) and one which applies to all claims filed after the decision date i.e. full refund before date and 'a partial fair charge refund' after the OFT decision.

    Hmm - what do people think - I'm a student so £60 is 2 weeks of my cash for food and things, but a hefty reduction in the amount refunded by the banks will hurt the pocket even more!<O:p></O:p>

    Last year we were in process of reclaiming our bank charges, we got to the position of proceeding to court, however, it was on the day the news came to light regarding the test case, and we did not get round to actually putting our case forward for court.

    What do we do now, has our marker been placed, or do we have to start over from scratch.

    Any advice would be appreciated.

    Hi........in view of todays court case i'm wondering if i will still be counted as already lodging my claim with the bank? I sent off the first sample letter and had one back saying they wouldnt refund, i couldn't afford to go to the next step by paing fees to a court so i didnt persue it any further, will i now not be counted?
    any idea folks?
