It does say "subject to availability" - they could just say they've run out and they're free and clear.

We have agreed to buy and the house is being built now. Due to complete in July. I have spoken to the Sales Manager at the head office and she says that the Sales Director has said that NO vouchers will be issued, even if it is advertised on their site. When I asked why, they said 'They are subject to availability'. She said that the sales advisor that we have been in contact with us should have told us about these vouchers. But she says she knew nothing about them!
She wouldn't explain what - 'subject to availabilty' means. They wouldn't answer me when I asked whether they had them or not.
I asked them to place this in writing to me, with the reasoning behind the refusal to issue the vouchers on completion, they refused.
I might get in contact with an independant solicitor for this.

The trouble is that in this country buying a house is not certain until contracts are exchanged. Until them either side can pull out or change the terms of their offer.

Can I ask, where do you think you entered into a contract that entitled you to £5,000 of vouchers. Was it when it was advertised ? When you walked in the door ? When the offer said, "subject to contract" (clue's in the words).

It's sharp advertising - but is it in the contract you have signed ? Or did you not read it (if you've exchanged) ?

you're going to lose - the best you can hope for is 'goodwill'.

Not sure if you have ever tried to get Trading Standards involved but, in my experience, they will need convincing before they would take it on.

Why would Trading Standards get involved, Bellway have done nothing wrong!

The advertisement on their website clearly states that the offer is available on selected plots only (probably the ones that they are having trouble selling). So, for instance, it may be that the OP bought plot 12, but the offer was only available on plot 13. At no point was he told that it was applicable to his plot.
    Gone ... or have I?

Just to let everyone know - Medway Trading Standards are involved now, and I must say, they are VERY interested. This 'offer' has now been withdrawn from their website, not sure why! They had no T&C except 'subject to availability'! - This is ongoing.

    Any comments appreciated.

Take care people - and thanks for your contribution.

We have already got a little bit off - they won't move on any more.

    Oh, I bet they will.
