All you people on here trying to claim for an "elderly" person. Surely the Mental Capacity Act 2005 may come into play.
Its about people being able to make informed choices. This is not just for Elderly it can be for any age taking in dementia and mental disability into making informed choices.

I will have to add mine on here again, yet the rebate I received was not a bad one but it was mis sold........
When we won our case from our loan advance through the FOS, I did note on his statement/findings etc that he adds these as separate loans where he stated that both me and hubby were then free to pursue the broker of this for the first sale of the loan/ppi, so that is when we decided to do this one now, but confusing issue this.
This one though is actually in with the FSCS now though due to the broker firm dissolving in May of this year, but also registered with the liquidators, so the FOS are unable to take this case on due to them not trading anymore.
So I thought they will require the figures for this.

Thanks guys - I think we'll go with the FOS, should we send this latest letter to the FOS as part of our case? I would have thought that it all adds to our case and also do you think worth mentinoing to the FOS that as a result of the mis-selling my Dad is now in even further debt?
Also, included in the last letter Norton sent to my dad there was loads of information sheets about the PPI with all the conditions etc; my Dad said this is the first time he has seen them so again probably worth mentining to the FOS incase Norton say they provided all the info before he signed up to it? It will be our word against theirs but again may help us.0 -

I would send all information that you have to FOS. How old is you dad do you think he was treated fairly? Is he able to make decisions or do you think he was forced into taking these PPI out when he was perhaps not able to make correct decisions.
Sorry not being rude but do not know how old dad is etc and trying to get whole picture.
Thanks Maxdp - he's only in his 50's and able to make decisions; unfortunetly he's not very good at making them especially where finance is concerend and has dug himself into a big hole with regards getting loan after loan, each time getting more to consolidate etc etc. You name it he has signed up to! Of all the things that he has signed up to in the past this PPI really takes the biscuit; he still cannot beleive that he would have only been covered for 5yrs and also he takes medication for blood pressure which they never asked about which I understand may also make the PPI void if claimed on.
Of course Norton now send him all the bits and bobs that the claim he was sent in the first place and say other things were explained over phone but we're both confident that things were not explained clearly so hopefully we'll the FOS will see it this way. I understand that most claims re single premium payments are being upheld so I think the odds are in our favour.0 -

Thanks Marshallka - when I send this latest letter to the FOS I was also explain that finances are tough (partly as a result of the single premium PPI) and ask that our case be fast tracked.
If Norton were/are confident they are in the right then they wouldn't have made 2 offers so this second offer and everybody's encouraging comments on here have given us the confidence to keep going.0 -

Did receive a letter last week from the FSCS, at the time they added on their letter "Not in default" have not checked the updates yet though on the site if done yet.
Its all time consuming isn't it hun ?:rolleyes:
I had to send further evidence to FSCS which I sent by email attachment yesterday, you are allowed to do this as they confirmed this by email, so hun if you anything further to send them do this by email attachment and not to forget your FSCS ref number.;)

Thank you for explaining but Mental Capacity does not just mean people are old it means they may not be able to make informed choices. That could be anything as in PND Post Natal Depression, Bi Polar Disorder Schizophrenia or mental health breakdown perhaps even stress. It is about being able to make choices which are beneficial for you. Know this has not been bought forward before but am wondering if this may make a difference. It may also be somebody who has a low IQ so then not able to make practical choices.
Not wanting to label your dad but just putting it in to the pot.:D:mad:0 -

Thanks - no matter how confident any of us are it's a gamble if we go to the FOS; we just hope that the FOS end up reaching the same conclusion as usEven if our claim is turned down I wouldn't hold anybody on here even partially responsible as without everyones help we wouldn't even be in with a chance.
