    My father in law still in hospital , although he is recovering well.;)

    He is in a ward with some geriatrics where one of these is in his 80's and has dementia, bless him, well while visiting my inlaw last night this guy with dementia said night night to us, pulled his curtains round, then 5 minutes later he got back up, opened his curtains around his bed and said "Good morning, what day is it"? lol, bless him, he thought he had been to bed all night and thought it was the next day already lol.....:o :D .

    My poor father is only 67 and was diagnosed with Dementia when he was 60.:confused:

    it's a dreadful thing - sound in body but not in mind - makes you wonder - flippin eck we'll be slitting our wrists soon - good job we're not drinking !!! :eek:

    Aww, your right there hun MEN are very mean.......:mad: , I get that too...:confused:.

    We also have a black cat, he is male called Lucky, my hubby had brought him home from work 2 years ago, (my hubby worked in a steel-plant) where there were a load of stray cats who had kittens, well Lucky was abandoned by his mum, he was only about 4/5 weeks old.
    We had taken him to the vets, got him sorted out and he is now very protective over me, love him and if hubby clowns around he will stand in between us and spit at him lol........:rotfl:

  • Whilst I await my reply from Firstplus. Ive sent an email to Techie help desk at FOS putting the following questions to them.


    Hi,
    Hope you can give some advice please.

    Me and my wife took out a Loan from Firstplus with a 5k PPi package kindly added by Firstplus.
    I sent them a letter on the 9th of September telling them I was seeking compensation for mis sold PPI. (I've only just found out a claim is possible)

    We took the loan out on November 2002 over 15 years and settled early in April 2005. I suppose the burning concern I have is about timescales - I am very close to 6 years since taking out the loan.

    How would this apply if for example, Firstplus stalled on replies until December and then claimed I was beyond 6 years. Do I still have a case to pursue?

    Another question, if Firstplus go beyond the 8 week time limit for mis sold claim investigation would it then be appropriate to complain to FOS, bearing mind that Firstplus have been members of the GISC since November 2001.

    I will feedback any answer I get to forum.
    hi there, maybe I can help - the 6 year rule you're referring to is under the Statute of Limitations Act 1980 - this rule applies when going to court in that a court will not support any claim over 6 years ago - so if you were taking the court route you'de have to start proceedings before November 2002 (there is a section of the above mentioned act which allows a claim to go ahead beyond 6 years but it is not without risk)

    First Plus have 8 weeks in which to respond to a complaint - this is set out in the Financial Service Authority's handbook on dealing with complaints. If they go beyond the 8 week period you can complaint to the FOS on that aspect alone

  • Hi there. I have a couple of queries and really hope someone could give me some advice.

    First of all I took out a top up loan with blemain finance on 31/08/06 and paid it up in full on 03/07/07.

    The loan amount was for £6312 and the ppi was £812.00 single life and asu.

    I have put a complaint in to blemain re the ppi and as usual they told me to get lost so that is now in the hands of the fos. i also cancelled the policy and blemain have offered me a refund of £203.00 in full and final settlement of the complaint. Not sure what to do about this as I could end up jeopordising(?) the original claim with the fos. Any thoughts please?

    The second query is with barclaycard. I have a claim with fos about ppi. They have written to barclaycard and barclaycard have written back to me saying that ppi was taken out on22 january 2002 and they regret to inform me that due to the length of time elapsed, I believe your complaint falls outside the scope for investigation. If a complaint relates to an alleged breach of duty outside the last six years, it is considered time barred under the statute of limitations. It goes on to say it is up to the fos to decide whether they will insist on a review.

    I cancelled the policy in august 2007 but stupidly didnt write to them til may this year.

    Is this a case of you tried but forget about it or is there something else I can do if the fos say no?

    As regard Blemain then its up to you whether to accept their offer to you but it will be full and final and yes it will jepodise your other claim too. You have to think that with the complaint at the FOS if you are going for misselling then you will be put back into the position usually as if you never had the ppi at all and get back all the interest too so this offer amount to me seems very low.

    As regards Barclays too. Did you get a final response before going to the FOS or did you complain to the FOS and they write on your behalf. If this is the case then does your letter say final response on it. If it does then FOS will look into this and tell you if its something in their jurisdiction I would think. If they wrote on your behalf then this to me sounds positive. Fos has a rule whereby its a six year, three year and "when you became reasonably aware too" and they can apply any I think so ask them about this letter from Barclays and if not then there is always the courts (although again a risk as this could be thrown out as statute barred there).
