On the Endeavour complaint, they did send the form back to me about the mis selling because they were not covered, but also added a note to state if they have overlooked anything is to return the form with the information missed, (in their own words), will see if I can find the letter later.;)

(this later I realised I could go for the unfair rebate) and not that of mis selling which is why I am trying to battle that part with Click.

And as you know I received a letter from the FOS last week to tell me as this is a brand new complaint "unfair settlement", it is likely they will be able to look at this, they also started a form for me ready and added Nov 2005, the date of the settlement and the reasons etc.;)
So Tiggrae was right in that they can look into unfair rebates then. Did you actually ask about it and they tell you it is likely then?? I have not had any word from them yet about this unfair rebate thing.. I hope and pray then can look into them and its the date if settlement that counts.

"""""In writing to the FSA about the issue the FOS has triggered the so-called "wider implications" procedure, under which the FSA will consider if taking wider regulatory action is a better option than the ombudsman deciding individual cases.

The FSA said: "The FSA is reviewing the position in the light of the information it has received from the ombudsman service, and the information provided by its own ongoing thematic work on PPI. It will make a decision on possible measures to take on the basis of this review in due course." """""

I had put it into writing in August to them by email, was not in any rush at the time and yes they put it in writing through the post, that because this was a brand new complaint on the company and they were under jursidiction on unfair settlement It may be eligible to get looked at, with the letter they enclosed the form and already completed some of the details for me, such as the company, the date we are complaining about and the reasons, "unfair rebate settlement".
They have already given a new ref number on the form and added so that the FOS would see this (nothing to do with the mis selling complaint);)
Endeaviour only have until the beginning of next week then their 8 weeks are up going from the first letter we sent to Endeavour.:D

So if I have to take my Future Mortgages to the FOS can I put in two complaint forms at the same time one on rebate (2006) and one for mis selling (2003) in case the mis selling is not in their jurisdiction?
They are two separate complaints like you said so you would have to send them separate. I did read though that Laini went for unfair rebate and misselling with FIrstplus and i think she did them together. Have to check back over her posts.

Here is what she posted (hope you don't mind Laini:D )

just to say we have taken our unfair rebate and missold ppi to FOS.
do they really think we wanted to borrow more to put in their pockets and if it had been explained to us the real deal we would not have taken it.
keep pushing we cant all be wrong and why is this site here to have a joke on us?- NO because we all know we have been conned into financial situations we didnt understand and were pushed into.
    good luck
    Laini xxx:mad::mad:

    TOOK OUT LOAN NOVEMBER 2006

we settled in Jan 2008 but had started our complaint to FP in october 2007 so said we would pay the settlement figure they were asking for but would be taking it further for mis sold and unfair rebate to FOS.

    Laini xx

So we need to ask how Laini did it really???

they're not always good news these - the last one was bank charges and all claims were suspended pending the outcome - still on-going over a year later

    PPI sales face new restrictions

The Financial Services Authority will consider the FOS's request at its board meeting later this month.

And in June the Competition Commission concluded that banks and credit card companies were overcharging their PPI customers by £1.4bn a year. It blamed at lack of competition at the point of sale when people took out a loan, and suggested that selling PPI at the same time as approving a loan might be banned. The commission will make its final recommendations in November or December.

So maybe we are better waiting with our complaints that we think maybe outside the jurisdiction incase something comes up next month or later in the year.
