    You pay £10 for a SAR, a Subject Access Request, which you send to your lender to obtain ALL the information held pertaining to your loan, telephone conversations will be part of this (if they have them !)

    Yes it was a secured loan that we settled in 2003.

    I wrote to Firstplus again last week and sent in a SAR too. It was about the settlement figure and the rule of 78 (I have written to Freedom Finance about the PPI as firstplus deny anything to do with it). I then telephoned them and spoke to the complaints handler (firstplus) and she again told she has written with the same information with regards to this. I have lost this one with them for now but i did ring the FOS who are sending out a complaints form to me. They say they cannot do anything about the ppi as Freedom Finance were not regulated by anyone at the time but they will look into the rule of 78, although they do say that if it was applied correctly then nothing can be done. I am so annoyed that nothing was out there to protect us back in the year 2000. I said to the FOS it was unfair terms and they did ask if i actually signed anything to agree the settlement figure. I really cannot remember doing this. Just have to wait and see.

    I feel the FOS is working on the side of the lenders. It was wrong and it was extortinate credit in my eyes and even if the rule of 78 was in the terms and conditions i don't think anyone that actually knew how to work this rule out would of taken out a loan with a company using this rule. If you don't work in the world of finance its a very complicated method to use and something needs to be done.

    I will continue my fight for now but must admit its giving me headache and i may have to use one ot the companies that say to challenge the whole loan soon if i can. I only wanted what was fair but they are not playing fair.

    Hi there!
    Can some kind person out there advise me on this one?

    I cancelled my PPI with MBNA last week. (I had to write to them to do so!)
    I recieved a letter from them today confirming the cancellation and then saying the following:

    'Your loan account has been credited with the rebate of £992.52. Accordingly, your monthly payment has been reduced...'

    Although it's only a reduction of £30. Better than nothing of course. What I'd like to know is are they allowed to take this rebate for themselves to reduce the balance of my loan with them - especially as this is a mis-sold loan of the single premium variety that had the insurance added on as a lump sum on top? Isn't it my money, to be sent directly to me?

    I'd appreciate it if anyone has any experience of this as I'd like to write back to ask for my money. If anyone has any ideas what I could put into my letter to persuade them to send me the money too, I'd be very thankful as I really could do with this cash!!!

    Doesnt seem to be anyone on here today ....you may have to wait for some "proper" advice....
    I am no expert, but I recall reading some points on Part 1 of this thread suggesting to people that it was "their money" and they should ask for the rebate to paid directly to themselves and not to be taken off the loan, I dont know whether certain rules apply, but if I were you , while waiting for some of the money saving experts to come back online, I would read through some of the old posts ...you may find what youre looking for.
    When you wrote to them , did you say you wanted the money to be paid directly to you?
    I would also read up on mcolaks posts about this "rule 78" and "fair rebates" and see what he had to say....there was some great advice.

    7) Did you provide the staff member with any details of any cover that was in place before proceeding with the application and what was the seller’s response?

    8) Did the adviser provide you with any brochures / literature regarding the policy and level of service that you being provided to you? If so please list the titles of these documents and, if possible, please provide copies.

    9) If there are any further issues you would like this office to investigate, please detail them below.

    10) Please provide any other information that you feel may be relevant to your claim.

    Is this a new tactic of the banks?
    Maybe I am being sceptical, but it sounds to me like they are trying to catch you out by getting you to put in writing that you knew about the PPI etc.

    Alternatively, it could just be fact finding prior to a refund.

    Personally I would not trust it and would advise you to be really careful how you answer it!

    I too have sent the first letter, and got the standard reply, so the second letter has now gone, I also am claiming the monies for the Breakdown Insurance that was added at a cost of £350 to the agreement, as this did not exist, I tried to claim two days after purchasing the car, and was told that the company I was directed too, no longer did work for Yes Car, I have been advised that they must have been aware of this, and were in breach of the Supply of Goods (Implied Terms) Act 1973. will let everyone know how I get on.
