I'm tackling First plus and central capital via the FSO as well. Keep getting letters saying they have no one to look at the case yet. did this happen to you? Is there anyway of getting the FSO to speed up? Any other advice on dealing with first plus most welcome as they put me i negative equity and the payments keep rising! :j

    Hi Dave.;)
I know there is a large volume of complaints and timescales may vary, but if your in a financial situation you can contact them and request for a fast track, you may need to send some evidence to prove this, such as a copy of a bank statement.
I have known this to help and get this looked at quicker, although I also know there is a large number in the same situation due to being on sort of a fast track list.

Yes this has happened to most of us here, infact I had a letter yesterday from the FOS regarding one of my complaints to confirm it has not been passed onto the adjudicator yet due to the large volume of complaints and they will update in about 4 weeks time, this is the 2nd letter about the same thing.

If your in this situation hun, contact them.;)

    Good luck !

:jBack on again - phew!!! I have been busting a gut ALL day to ask for help!!

Received a letter back from FIRSTPLUS (claim with FOS) Here goes, my comment is in blue!!
    DearXXXX

Following recent contact by the Financial Ombudsman Service, we have been given the opportunity to send you a further response to your complaint regarding your payment protection insurance policy.

bla, bla (mainly they are satisfied that they sold it to us fairly!!)

We are concerned that you are unhappy.....we would like to offer an enhanced rebate of the insurance premium. the enhanced rebate that we are prepared to offer you is calculated on a pro-rata basis of 78% of the insurance premium. (not sure why it would be only 78%!!)

Our offer takes into account the time the policy has provided you with cover (16 months) and the rebate is calculated on the unexpired term remaining (44 months). We took this loan out in Aug 2004, so I'm not sure where these figures have come from!!!)

This would mean an amount of £775.27 would be applied to your account in addition to the normal rebate of £17.55 payable on cancellation of the policy. (this PPI was for £5025. over 300 months!!!!!)

Then they go on to 'no admission of liability, but a gesture of goodwill'

PLEASE could someone help - my head is spinning with all sorts of scenarios - thanks in advance

Arh they have used the "rule of 78" then, this was the way they used to calculate which then changed to what I can recall in 2005.

Hopefully Tiggrae will be able to advise you here hun, just to make sure your not losing out here.;)

And they do not want to admit it was mis-sold but doing this as a goodwill gesture...... .

Okay at least this is something, but I would see what Tiggrae has to say or maybe one of the others who have experience with First plus, but well done anyway hunni. :j :D .

    Hello there.

As I assume this is a front loaded policy, you should be put back in the position as if you did not have the PPI to begin with.
They must refund you all paid in plus 8% interest on top of what a court would award.
If the loan is still active they normally recalculate to bring the amount down and I am aware you can request this in a cheque payment if you wanted to.;)

I do know that if the loan is settled, you will get back everything in ppi plus interest in cheque.;)

I agree with Di on this one. If they declare the policy missold they cannot leave the amount on the loan as it would be null and void.

  • Hi, Morning guys

My girlfriend was blatantly mis-sold her PPI by the lovely man at Natty west, having met him I can see why, he hasnt a clue.

We have begun the reclamation procedure and sent off the original letter, however it was by first class post and not recorded, this was around 3 months ago and we have had nothing back from them.

What should we do? Re-send the first letter or go to stage 2?

    All advice is welcome.
