:mad: Well have sent a very formal letter off today asking the chap in the compliance dept to send me out all paperwork including the PPI agreement where it was not me that filled out the boxes!!! I included a cheque for a pound as this is what they wanted!
I have told him that it is going into the hands of my lawyer who I also named and that I will be looking for the full amount plus my interest and legal fees when it goes to court!!! Will let you know but one things sure they aint getting my money just because of a stupid date;)
P.S Can I claim my legal fees of them as the actual PPI is only 319???0 -

My response to this letter would be "I have read your second paragraph with interest but I am unable to find any reference or guidance in the Dispute Resolution Handbook which sets out the FOS rules including the 2005 transition arrangements. Please advise the handbook reference and we will be pleased to investigate further"
I had sent this letter off before being aware otherwise on here, as its crossed over sort of thing.
I will post up with their reply when I receive this.;)

Hi guys, hope your doing better than me, i m sooooo tired... anyhow jsut to update you, ihave had no further response from the Adjudicator, last letter rec'd was 12 August 08, so really just waiting to hear what Halfax/BOS have got to say and will offer.
How long does this normally take?
I spoke to FOS about my mortage PPI claim, buta paprently they have not allocated this one as yet

After your case has moved onto the Adjudicator, time can depend on how complex the case is, and this varies.
However, now its in the hands of the adjudicator, I would just sit back and chill for a bit now, they may request further information and will write to you if you would like to add anything further.;)
This was in my case anyway hun of when mine was in with the FOS.
Fingers crossed you will hear soon.;)
They have so many complaints of the same kind which has been rising in volume every year, and before you know it they will deal with your other case.:j

Blimey, just noticed on the FSA site that they are going to be regulating "holiday insurance" from Jan 2009:eek:
How many claims will that be.

Perhaps Di should have mentioned the courts here as well.
This is after Tiggrae asked the FOS if they would look into this type of complaint she stated.....
for the purposes of di's case here - Endeavour did not come under the jurisdiction of the FOS when she was mis sold the PPI - however, when the unfair rebate was applied which was in November 05 they did. After speaking to the FOS about unfair rebates (ie after the FSA produced their findings on unfair refunds on single premium insurances see - Refunds of Single Premium Payment Protection Insurance ) then the FOS have stated they will look at this type of complaint - afterall if the FSA think they're unfair then who are we to argue - they are the UK's Leading Authority on financial matters and do now regulate the whole of the finance market
This is Tiggrae's view that she put some posts ago and she has stated that it is only her view.....
ie for all firms that were regulated from 2001 onwards their contract terms should not be unfair to their consumers - and they had an obligation under 'old' ICOB 5.1.4 - from the 'old' FSA Handbook (which I think has been in place since the FSA came into being )
Is this the handbook rule thing that tiggrae answered some time ago???????I hope you don;t mind me copying your posts Tiggrae.
