    Bit confused here, didn't you put your claim against first plus for mis selling?? and all the dates on the complaint were related to the mis selling date. If so, you should have made two complaints - one for the mis selling on the specific date of sale, the other for the unfair early settlement rebate, you can't make the two complaints on the same form !!!

    FOr misselling PPI i understand its the seller of the PPI but i was told (By Firstplus) that unfair rebate is against the lender...

    Could Tiggrae please confirm any of this....

    for an unfair contract term it has to be whoever you signed the ppi / loan contract with

    I would of thought this type of complaint was against the actual lender who loaned you the money in the first place. After all they are the ones rebating you with their rules etc. on the loan agreement and the loan agreement is actually between yourself and them and not the seller.

    Petermb was someone (not seen him around so much as M colak was always reporting him i think) who wanted us all to make the loans unenforceable.

    M colak is away so much lately. not heard from him for ages.

    Hi, It is not that I wanted or want to make loans unenforceable or voidable. They just happen to be unenforceable or voidable. The fact that most people are unaware of why or how is not really the question.

    My argurment is that those who seek to claim on their ppi only stand the risk of selling themselves short and getting far less back from the lender than they could actually be entitled to.

    I made no apologies for doing this stuff for a living and the mere fact that I do this for a living ought to put me in a better position to give advice than those who have merely been successful at making a few claims for themselves.

    Not detracting from anyone elses abilities whatsoever but to me, if you want some plumbing done you dont seek the help of an electrician.

    The
    don't let a claims management company harrass you in that way, say you'll report them to the Ministry of Justice - that's our regulator - if they're not with the Ministry of Justice then it's a scam !!! There are pleny out here that'll do it as a no win no fee basis !!!

    also a ppi is a ppi whether it's against a personal loan, mortgage or credit card and you reclaim against them all in the same way

    I did make two complaints but put them on the same form and then they changed it to two at their end and actually wrote that both complaints were outside their jurisdiction as the loan was taken in 2001 and ended in 2003 and that FIrstplus did not come under their jurisdiction until 2005. (although they were GISC members in 2001:confused::confused: )

    Your argument is a matter of morals to me. I borrowed money and i really do not expect to be refunded/compensated for money that i actually had and WANTED/NEEDED at that time. I only want a fair solution to this misselling and unfair rebates thing. I personally have no objection as to whether the paperwork was a little out of touch at the time of my loan but i do want things doing fair. Myself, I would not feel right asking for the whole loan to be paid back but of course i can see the reason why some people do. Everyone to their own.

    I totally agree, if you've borrowed money you should pay it back - I've lent money to people and never got it back - don't know how they can live with themselves and it really upsets me - I wouldn't be able to sleep at night - but again that's just my opinion
