Is this a statement that you could use to FOS or is this for the courts. Singlep says any complaint about insurance can be taken to FOS and agrees there but states that the sale date is still the date that FOS has to go by. If you are only referring to courts its a different matter but what does FOS have to go by???

Surely as well FOS understands we are not legal eagles and that we do not have to state the laws applicable at the time and know what we are claiming. We got stung by PPI and we can't claim for misselling but want something back in that we want a fairer refund making. Should that be enough or do we have to state these UCCTR's etc to them for them to be able to look.
no it's definately the date the unfair early redemptions was applied - I've got a couple on the go at the moment - for 1 of them the client had already claimed mis selling but it was back in 2001 (ie prior to them coming under the FOS jurisdiction and the complaint was rejected by the FOS), but the early redemptions took place in 2003 when this particular firm was a member of the GISC and it is with an Adjudicator now.

Another query (sorry) can any one tell me what happens regarding the loan if the FSCS are involved ,do they have anything to do with the loan going back to how it would have been without the PPI and do they pay interest?
From filling out the forms it seems that they just send out a cheque if they think you have lost out.

They can only award a certain amount of compensation i think. The details are on the site. I will be back with the link to it.

  • I have definately been mis-sold PPI but I don't know if I can try and claim back and cancel it if I am now under a debt management programme with CCCS and am paying reduced payments. Please help.

I will check through the paperwork I received from the FCSC, I'm sure there is some information on there, I think this is also on the site, it something like the first £2K then so much percent after but not the full smackers of it.
Thats the way I have read this.;)

Hi there hun sorry it has taken me some time to post back to you.
Been giving the lappy a good clean over.;)

I just added a post about this in one of the above, but to what I gather hun its the first £2k and so much for every hundred I think but not the full whack, will have to double check this.
I'm sure it did mention something on the paperwork, but anyway Marshallks have left a link, so it maybe well worth checking it out on there.;)

Thanks for that Di,I was just wondering though if i can pay the amount off the loan and get the loan revised without PPI, or whether they'll just take it off the loan still with the interest from the ppi on it. Does that make sense?!
