    Hi marshalka
    thanks for your reply

the loans were both in the opened within 6 years...
1st loan paid off via contra in 2005 , both had ppi....

copy of paperwork for loan opened in 2005 and closed early 2006 has been received by myself and copies were given to ombudsman. original paperwork from 1st loan never received from them even after letters sent requesting this

any thoughts ?? I know on 10july ombudsman gave company 14 days to reply...we are past this now ?? seems they are allowed extra time ?? is it possible to lose the paperwork, surely the data is stored centrally
Maybe tiggrae would be best to answer this one. I would of thought if there was no paperwork then perhaps FOS will automatically award the claim to you maybe but as i say tiggrae may have come across this before. Have you reported this to the ICO???

    Sorry cannot be more helpful

    Dear XXX XXXXX

Your complaint about Lloyds TSB Bank PLC

The large volume of cases we are dealing with at present has meant that we have not been able to allocate your complaint to one of our adjudicators so that it can be assessed.
However, we will do this as soon as possible and we will contact you again within the next four weeks to keep you dated on the progress of your complaint.

If you need to contact us , please remember to quote our reference. XXXXXXXX(PPI)XXXX

I was not expecting to hear any different, but fingers crossed it will be sooner rather than later.;)

The ICO is the Information Commissioners Office and they deal with complaints of this kind where companies fail to comply with the data protection act. The link is here

    http://www.ico.gov.uk/what_we_cover/data_protection.aspx

although if FOS knows about this and they still have not responded then they probably do not have these or ARE having trouble locating them. Its still not right and FOS will know that.

  • hi, i'm new to all this so forgive me if i'm going over old ground. took at a loan with first plus and took the ppi on the assumption it covered me for the full term. since found out that it's only five years and so intend to try to claim it back.

i've spoken to first plus and they've offered a refund of about 20% of the original premium & a reductionon the monthly ppi payment of about £8 out of around £37.

should i ignore this initial offer and plough straight in with the claim for the full amount or accept this and then claim for the remainder? will accepting the initial offer affect the outcome of anyfurther claim?

any advice gratefully accepted and much appreciated.
