I have been waiting for a good 6 months for the financial ombudsman to even assign my claim to someone to look at. I called them today and they advised of a huge backlog but couldn't tell me how long i would be waiting and could not give any further information.

My previous claim wqith HSBC was resolved within 6 weeks or so

Does anybody know anything about these delays or had any further information?

    Cheers

hi, can someone help me please,

i've recieved a letter from lloyds tsb today rejecting my complaint for mis-sold ppi, but i'm not sure if it's a final response. the last page reads:

i am sorry that my decision was not more favorable to your complaint. should you wish for the financial ombudsmen to independently review your complaint, you must refer the matter to them within 6 months of the date of this letter.
is this a final response? or should i send off a 2nd letter before going to the fos?
    thanks, james.

I think the FOS used to get about 2000 complaints a year and now they're getting more then that a month and as they are a governement body deciding upon peoples money they have to be really well trained !!

    Hi there folks.

Sorry I have not been here much today, will try to get some of the posts sometime later or so.;)

Right, have more claims to sort out and will try to catch up with the posts here later, but it looks like our Marshallka, Tiggrae, M Colak, etc have been an amazing help as always.;)

    try this
Unfair Rebate Settlement/Account policy number –

    Dear Sirs

With regard to the above, upon early settlement of my loan in November 2005, I only received a small proportion of rebate against the Payment Protection Insurance, which I believe to be unfair under the Unfair Consumer Contract Terms Regulations 1999, especially considering the loan / PPI was taken over 25 years and settled only one year later

I am also aware the FSA have stated Companies should provide a fair refund upon early settlement.

Also, as only a small proportion was rebated, yet your own Marketing state, ‘if settle early you may be entitled to a refund’ in my opinion I did not receive a refund and believe this statement to be mis-leading and amounts to Negligent Misrepresentation under the 1967 Misrepresentation Act.

In summary, I do not feel I was treated fairly, should you fail to uphold my complaint by which I believe you unlawfully deprived me of approximately £3722.68, if this amount plus 8% Statutory Interest is not forthcoming, upon receive of your final response I will without further notice take my complaint to the Financial Service Ombudsman, on the grounds of an Unfair Settlement Rebate.

I look forward to receiving your response within 14 days of this letter.

    Yours faithfully

Tiggrae - when MColak worked out my sums for me he said that I had also had an unfair rebate - I never mentioned this in the letter about the mis-sold PPI, will I have to write another letter specifically for the unfair rebate or will it all be covered? many thanks

I think you can either go for unfair rebate or the missold ppi??? Check with Tiggrae but almost sure. Apparently unfair rebate is much easier to go for but less money as you only get a proportion back and not the full amount.
