    Bespoke/Freedom???, still ongoing but started one with the Co-op bank now. I am waiting for a reply from my second letter. I should be able to go to FOS with this one hopefully.

    I have asked Tiggrae about it but no reply as yet. I wondered if i needed a SAR from them as i have not requested it yet. I think i will do this now. I only have until December 19th so need to get things moving fairly quickly. I have requested a copy of the agreement now 3 times by telephone and once by letter but still nothing from them only a letter to say that we had been sold it fairly. I am going to SAR them now.

    go for it! acn't believe bespoke/freedom are still dragging this out! can you get to a co-op bank? if so make the complaint in the branch - they enter it all for you and send it off and give you a copy - with a ref no, that's what I did for the PPI on my overdraft, and they can't deny getting it either as it's processed through their own computer system by one of their staff. When i did it in the branch - I had a letter within 5 days saying they were looking into it - the 8 weeks is not up yet though so still waiting.
    LTSB PPI - £770 ish for dad
    LTSB PPI for dad - £1800 for dad
    Barclays PPI claim for self-£2204
    Dads home insurance - reduced by £200 a year "WE DO NOT LIVE IN FLOOD AREA AND I DON'T SEE WHY WE SHOULD PAY FOR THOSE THAT DO - I WANT TO SPEAK TO YOUR SUPERVISOR"!

    I have had a letter back from them stating that they sold it fairly so i have now sent my second letter to them recorded delivery and they should have got it today. I requested a copy of the agreement ages ago (perhap 8 weeks ago) and i have also written to ask for it by recorded delivery.They have replied to the letter but not sent the copy of the agreement. I have now done my SAR letter which i will send tomorrow. I feel blummin annoyed that they have not sent it yet.

    Thanks for that. So i should just leave it and wait for the ombudsman to get back in touch. They've had the complaint since beginning of Feb, any idea how much longer it should take to be delt with anyone?:confused:

    More and more I read about this and look at the paperwork I am mad and upset that I was not told about this by the sales person. I know I have to accept some of this but they didn't care at all about my interests.

    The IVA is completed and has been for nearly 3 years so could it still be classed as a breach, would I have to reopen my IVA? As far as I was aware becuase it had been closed the debt was satisified.

    In any case is best to go straight to FOS rather than direct to HFC? Is it okay to do this? I don't want to be seen as underhand I've only just realised this and had I know about this would have raised whilst in my IVA. Is there a link on advice on how to complain to FOS?

    Ok first things first:

    Single premium loans are ones where the PPI is added as a one of payment and interest is charged on top of it.

    Mulitple premiums are used in the case of credit cards where the PPI is calculated monthly and therefore the figure changes however interest has been included in the figure.

    Front Loaded policies are ones where the PPI/PPI Interest and Interest ion the loans are paid off first before you actually see your actual loan decrease.

    Non-secured loans usually have interest previously worked out on the whole of the figure and therefore payments stay the same all the way through the loan.

    Secured loans/mortgages are affected by interest rates and therefore the amount of PPI interest can go up and down.

    As for your IVA if it has already been settled then the only thing the company will try and do is withhold a certain amount of the refund due to loss in interest which they could have received if the loan hadn't been frozen. In ALL cases where there is an IVA i would recommend after the inital letters and getting their final response (whether you agree or disagree) go to the FOS to ensure you get the best deal.

    count the weeks from the original letter and as soon as it goes over the 8 weeks ring them and tell them you are ringing the ICO and the FOS, then give them another week and then report them

    Depending on whether your case is a hardship case or not then it can taken between 6-9 months. PS have been waiting since January for one of mine.

    Hi there folks.

    Sorry I have not been here much today, will try to get some of the posts sometime later or so.;)

    My sisters had taken me out for my 40th birthday treat.....;) , have had my hair cut and coloured foils, and wow I don't even recognise myself lol.:D (although I'm not 40 until tomorrow - I've been spoilt rotten):D ;) .

    Tiggrae, thanks for replying.

    However, The Unfair Consumer Contract Terms Regulations 1999 refers to "individually negotiated" terms. How are you meant to know if this has occurred?? Surely the company can say that this only applied to my circumstances??

    In my example, I was provided with a personalised illustration at the point of sale, which was obvioulsy for my cirecumstances (e.g. loan amount, product, personal details), but it is contained in the small print at the back that MPPI is compulsory, although this does not affect my stautory rights, and I was provided with details of a cooling off period

    it's the fact it had small print on the back - that's a contract which has not been individually negotiated (ie it was already written in advance) - if it actually states you had to have the insurance that's probably one of the clearest cases of mis selling as there is no legal standing for that contract clause, it's clearly unfair

    really you only need a SAR if the company wasn't regulated (ie if you can take your complaint to the FOS) they will get all the details - otherwise you're wasting time waiting for the info to arrive only to then go the FOS
