    Dear all, I have to have my Allocation Questionnaire back at the County Court by Monday. In relation to the mediation element, is this something that I shuold consider or shuold I just go straight to the small claims?
    Almost debt-free, but certainly even with the Banks!

    I phoned up a couple of days ago to check if my Cap One claim was OK as I'd read on here they weren't covered by FO but I hadn't heard anything for months so wasn't sure what was happening - she said just store cards and HP weren't covered and wanted to know who had told me otherwise.

    Just sending a request for a copy of all my information from lombard direct, to see if I was in fact charged for PPI. Got this template from another site. Just wondering if this is suitable, and is there anything I need to add or remove?

    SUBJECT ACCESS REQUEST

    Dear Sir or Madam

    I understand that you currently hold details of my personal and financial information within your internal record systems with regard to personal loan accounts.

    Please supply me with a complete list of transaction and charges relating to my history with your organisation, INCLUDING loans, payment protection insurance and other products. Alternatively a complete set of statements for the accounts or associated accounts is acceptable. I would be grateful if you would provide the following for ALL accounts or associated accounts I have held with your organisation.

    - Full copies of all contracts which you believe exist or have existed between myself and your organisation, including true copies of any documents you hold in support of the same.

    - A complete list of all transactions or statements relating to ALL of my loan accounts with your organisation.

    - Copies of all documents which include any of my personal information including copies of any contracts or invoices, emails or computer records containing my personal information, or any records which pertain to this information.

    - Full copies or transcripts of any correspondence in postal, email or any other formation which you have entered into with any individual, organisation or third part which contains my personal or financial information, or which pertains to me.

    - Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction. Where you are unable to provide such certificated, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.

    - Full hard copy print outs of my personal or financial information, held in a digital, magnetic or any other formation which is held in any archives, backups or other storage devices / locations.

    I enclose a postal order of £10.00 to cover your fee.

    IF YOU ARE UNABLE TO DEAL WITH THIS REQUEST, YOU SHOULD IMMEDIATELY FORWARD IT TO THE PERSON WITHIN YOUR ORGANISATION RESPONSIBLE FOR DATA PROTECTION.

    Hi has anyone on here been to court hearing to put a judgement aside? I just wondered what paperwork i should take? I received a letter with the date but it didnt say anything about what paperwork i should take,maybe i dont need to take any as its only a hearing?advice please?:eek: I havnt got the original paperwork only a photo copy hope thats ok:eek:

    Hi i have two store cards being sorted out by fos and they have been with them since feb i took them out with ppi in 2003

    Ok. Will let you know when I get a response. Do you know if I would have to go to court or are they one of these companies who threatens and then pays up at the very last minute? I don't want to have to pay for a court hearing when I'm only trying to get back £72 :p

    Just a little update. I received a letter from Lloyds TSB loans saying that they were sorry I felt I had been mis-sold and that they were going to look into my claim and get back to me as soon as possible- so guess it is just a waiting game.

    I am still waiting to hear from card services however- only been 2 weeks so far.

    Good luck to all those trying- hopefully we will get somewhere soon

    My oldest son he is 19 now and a university student, last year he went into Burtons store to buy some clothes for his prom, he was sold a Burtons store card, but as he's almost finished paying it off, its only now he has shown me his statements where I see payment insurance is added, he said he thought it was part of the card, it was only a few months ago he said he received his policy details.
    I asked him did they mention this to him in the store at the time if he wanted it, he said nothing was mentioned but was given a form to sign for the burtons's store card.

    Now checking through this, as he is not working he would not been eligible as a student anyway, so he has one more payment left to pay, and I'm going to help him pursue on this, from sixth form he continued at university where he has yet another year to go, I think as being young, these youngsters are vulnerable.

    I will keep you posted on the progress of this and post up when I've started the claim.;)

    Still no news from Freedom today but i have now sent another letter to Firstplus stating that as lenders they should ensure the fitness or their "brokers" and i feel that they have failed on this score.(I have stated that i have sent a complaint to the OFT in regards to Bespoke and this includes them as lenders section 25 CCA). I have sent it to the MD and also said about Freedom/Bespoke not being registered at the time of our application with the Data Protection Act. Just keeping them informed.

    Might use section 25 of the CCA for both Bespoke/Freedom too.
