    :eek: Good luck Yeosal. Go give it to them. This is the first case that has got to court that i know of besides M colak. Let us know what happens.

    Thats why I am worried, everyone has settled before now. I question what I have done wrong in my claim. Where is the justice! People have got their money back from one letter! :mad: This is a genuine claim and I just keep telling myself that.

    Got the allocation questionnaire for the next one to be filled out, but right now I would rather cancel the whole thing.

    Yeosal, believe in what you are doing and you will win. The trouble is that you are not used to this "court" thing and me neither and we alway associate "court" with the seedy side of life and never experienced (hopefuly) this kind of thing and it is scary. You will be ok. Are you taking someone with you??

    Just had my reply from Freedom Finance and its says

    "Further to our telephone conversation and upon request of Bespoke Finance Ltd, Freedom Finance PLC has agreed on this occasion to investigate your complaint. Upon completion of our investigation we will inform you and Bespoke Finance Ltd of our findings.

    We hope to complete our investigations as soon as possible. We trust this clarifies your current position."

    Another stalling method.:mad:

    And note they still say they are dealing with this for Bespoke. I did not have this through BESPOKE. I posted something earlier from the costa del sol action group about Fidecs who now own Bespoke and it was something about being unregulated in spain although regulated in Gib. Does that apply here as well in that i have no hope. Is it really right about if i do take them to court (and its looking that way) that if i use a UK court then uk bailiffs have no jurisdiction in GIB. Its looking hopeless here and i just have to keep googling things. I think i may have to take some legal advice soon as this is tooooo difficult to go it alone.

    No-one can help from the FSA, OFT and FOS and it really annoys me as i have been ripped off and mislead too. Its just not right.

    No, am going alone, probably better that way. The judge may take pity on me. Hope there is no delays. Cant believe I actually paid £300 for this hearing! I am so nervous though, my stomach is tied in knots and I feel sick (bit like I did when I got married!). Their solicitors are rottweilers and think they are going to wipe the floor with me.

    [FONT=Tahoma, Arial]We have recently received correspondence from the Financial Ombudsman Service
    regarding their review of your complaint and your acceptance of their
    adjudication.

    Their decision includes a recommendation that a full refund of the payment
    protection insurance premium plus any interest be refunded to you.

    In order to comply with this recommendation, please find enclosed an amount of
    £15,388.29 in respect of a full refund of the insurance premium and interest
    paid on the premium through the term of your loan. This amount is being
    refunded to you in order to put you in the financial position you would be if
    the insurance had not been taken, as laid out in the Financial Ombudsman's
    recommendation.

    When you settled your loan account a rebate of £4,121.10 was included in the
    settlement figure. This additional amount represents an additional refund of
    £13,021.90 to give a full refund of £17,143.00, and a refund of interest
    amounting to £1,774.54. This also includes an amount of £591.85 in respect of
    the 8% interest on £14,796.44 from the date your loan was settled to present.

    To clarify the details of the redress as set out in Mr Meredith's letter:

    a) Settlement figure paid including PPI and rebate £83,759.78
    of £4,121.10
    Total premiums paid including cost of PPI £8,390.90
    Total = £92,150.68

    b)Settlement figure assuming no PPI taken £70,614.02
    Total premiums paid assuming no PPI taken £6,740.22
    Total = £77,354.24

    c)Difference between a and b = £14,796.44
    8% interest on £14,796.44 = £591.85
    cheque £15,388.29 _party__party__party_
