Another quick question, I noticed on my Experian report that I have had several dealings with HFC bank, if I send an SAR do they have to give me details of all the accounts I have held with them? If so do I alter the SAR request letter to reflect this, even though I don't have account numbers for them?

As I've already mentioned, I am sorting out PPI reclaims for my parents as well as myself.
Dad has had a reply from Endeavour today in response to his SAR request. They have asked for proof of identity and address - fair enough, I can sort that out.
However, as this loan is in both my parents names (even though the PPI covers Dad only) they have asked for another £10 and proof of id/address for information relating to my mother.
Can they do this? I was assuming the SAR would cover everything to do with the account.
I'm ready to send the extra money and info, but just wondered if this was normal?

Just an update.
Received the response from the FOS this morning, as expected due to the fact Endeavour/Click Finance ltd (the brokers) were not regulated not even by GISC back in July 2004, they are unable to proceed with this complaint.
As I said I expected this as a response anyway, but feel I should exhaust all avenues before thinking about the court action.
However, the FOS did give a name and address of the FLA (Financial Leasing Association) to see what they can do.
Instead of writing I emailed the above FLA, and within 10 mins they got back and said that they have no code covered for Endeavour,so they can't do anything, so I have since emailed FISA, which the FLA advised us to do, not sure what they can do though but it may even be worth trying this one with the Financial compensation scheme for consumers - again though they may have to have been covered or regulated back in 2004, not sure.
And as the brokers Click Finance dissolved in 2006, I just feel I will have no luck at all with this one, unless I take court action.
I just feel so damn annoyed paying this loan off 24 years earlier and not a lot to show for it in rebate, that was settled and calculated by Endeavour themselves :mad: , so any further advice/info in what you would do, I will be very happy to hear, thanks so much you lovely helpful folks.;)

The FISA will only look at compensating for mis selling (for companies in receivership) which took place after 15.01.05, if the mis selling took place before they won't look at your claim. As Click finance are now dissolved, you have 2 options - you can use Section 75 of the Consumer Credit Act 1974 to make Endeavour responsible for the actions of their agents, but as both companies were not in the jurisdiction of the FOS this would mean commencing court action, or what you could do is go for Endeavour over what you believe to be an unfair rebate received on early settlement - if you settled your loan after 15.01.05 you can complain to the FOS about this rebate but you'll need to start the process all over again and get a final response from Endeavour - if it was prior to 15.01.05 then again you're talking about starting court action.

We purchased the product in July 2004 and settled in Oct 2005.
On the Credit agreement itself it states it was regulated by the Consumer act 1974.
The loan was £21,000.00
single ppi was £2835.00
Total amount with the both above: £23835.00.
To settle this in Nov 2005 we paid £23646.04
In the SAR docs, the full amount paid all in all for this loan was £26565.18.
The settlement date used in calculation of the rebate is 30th November 2005, it has been calculated in accordance with Regulations 3 of the Consumer Credit (settlement information) Regulations 1983.
The amount of the insurance rebate has been calculated having regard to the Consumer Credit (Rebate on early settlement) Regulations 1983.
I find your information very useful and helpful.
However, as these were also part of the HFC bank do you think I should try to pursue through these ?
I understand these were regulated in 2001, please correct me if I'm wrong here, cheers.

Can't wait for the post today as i should be receiving a letter from Freedom Finance about my claim. They will write that i was told that Bespoke were involved at the time of the sale but i KNOW we were not. They will also say that they called us on behalf of Bespoke to talk about the ppi and that we were made aware that it was optional. Again, wrong. The man from Freedom i spoke to yesterday was completely ignoring me when i stated this and just carrying on talking down to me like a child. He said that he should be writing all this in a letter and sending it out yestersay so hopefully will receive it today. I think although their web site says now that they process loans on behalf of Bespoke not a lot of people still would know what was involved with making a complaint to them. They would not know that they are dealing with Gibraltar. The whole site is STILL misleading. They call themselves

If you look at all the press reports on these there is NEVER any mention of this Bespoke thing. (YET??????????????)
Also can a company that offers finance and has a web page not have any terms and conditions on it or legal and privacy or address of any kind????
Also can they be "members of the Data Protection ACT".

This is a Gibraltarian Company not registered in Spain.
Paul Nichols operates out of Nerja to obtain sales.
Although it states in their advertisements regulated by the Gibralter Fincnacial Service Authority this cernatinly is not applicable to those living in Spain.
One of our members invested money with FIDECS and suffered considerbale losses and have been advised by Gibralter Lawyers that to sue for negligence in Gibraltar would cost cost a fortune as there legal aid.
This has now been referred to our Spanish Lawyers
I don't want to be doing this everyday, digging dirt but they leave me no choice as i still don't know what i am dealing with. Tiggrae, if you around could you please explain this one. I really do not understand and Freedom are adamant that i was sold all my loan and ppi from Bespoke and is this how it would be for me too in that it would cost me a fortune if i did take this to court. The more i look at things the more i feel like jacking it. They have me by the short and curlies and i DID not go through these people and was NOT told at the beginning of it.
