copy all the sheets with nasty comments on and send them off to their Chief Excutive - tell him his staff are rude and unprofessional and as you've now got the evidence you're going to sue his company for libel - in fact you could thank him for providing it !!!

That 4K is definately challengable. Were you informed of the commission. You need to look at "secret commission" in the CCA1974. Take a look at this and get complaining. http://www.oft.gov.uk/shared_oft/reports/consumer_credit/oft301.pdf
It was not regulated was it (under 25K). Its still excessive though and worth complaining about.

and this one too if it was unregulated

Brilliant info hun, thanks so much indeed.

It was unregulated, the loan was fifty odd thousand with ppi added.

Will check these links out hunni.;)

depends upon when you took out the insurance - they wern't under the financial ombudsmans jurisdiction until 15.01.05

It was April 2003 - does this mean I have already wasted 3 months waiting on the FO and could wait about another 3-6 for them just to tell me they can't help?

And does this apply to insurance only as they 'sorted' my bank charges complaint?

that's ok then - basically, you're only redress against this company is to start court proceedings, if you'de lived in Scotland, dealing with a Scottish based company you would have had to use the Sheriffs court in Scotland which is a nightmare !!!

Can I ask why you say this as it may be my only option?

Some broker information when arranged through e-loan who provided us with a Nemo loan/PPI. (FIRST TIME WE HAVE SEEN THIS INFO DUE TO THE SAR RECEIVED TODAY WHICH WE DO NOT SEE OTHERWISE)

    DATE: 18/11/2005

    BROKER: e-loan

    NAME (customer)

    APP NUMBER: XXXXX

    PLAN: 1

    LOAN AMOUNT (EX PPI) £43,000.00

    LOAN AMOUNT (INC PPI/FEE): £51,492.50

    PPI AMOUNT: £8,492.50

    APR 7.4
    TERM 300

    COMM RATE: 9.00%

    COMM DUE: £3,870.00

    PAID: £21/11/05

    U/W: RT

Now does this sound like commission to you folks or have I got the wrong end of the stick ?

    Cheers ;)

banks have always been covered by the FOS so they could sort out bank charges, but the independent lenders only came under the compulsory jurisdiction of the FOS on 15.01.05

if you live in Scotland (?) and the Company you're dealing with is Scottish then you have to use the Sherriffs Court - their limit in the small claims court is £750, as apposed to the County Court in England which is £5000. Also, you have to issue writs and is quite complicated so you invariably need a scottish solicitor, whereas in England you can do it yourself
