    Many thanks for your reply. I have sent Barclaycard a quick e-mail today asking if there was any chance I could get my limit back to what it was - I believe the reason it was changed was because at the time I was near my limit of £2500. Currently I have £2020 on the card and find it really frustrating I am hit with over limit fees. I have to wait 3 days for a response so will see what they say. I have already submitted a letter asking for a full list of charges which I am waiting for.

    I am also claiming PPI from this card which I have just sent off a complaint form to the FOS as they sent me a Final Response letter yesterday saying that my case does not grant any compensation as I should have opted out in the 30day cooling off period. I've had the card 5 years!

    Do you think I stand any chance? Thanks


    You've got nothing to lose, so go for it. I found myself in a similar situation with PPI on a loan. I just had it added on by the bank and believed it was part of the interest I was paying. This was back in 2001 when (just like you wrote) I was young and naive :o . I also had PPI on a very old MBNA card and didn't have a clue what this was for until a friend pointed it out and I cancelled. I remember very clearly that the salesperson desperately pushed his advice of not cancelling. He really went for the hard sell. It took about 15 minutes of me feeling really pressured!

    Consider which category you fit in for the mis-selling of your policy. There may be more than one. If there was insufficent information given to you quote the 1967 mis-representation act in your letter to Barclaycard. I suspect it was one of those little boxes (perhaps even pre-ticked by them).     Yes too right you should thats what i would do , i won my judgement on 20th may and they wrote to me on 22nd so you should have heard back from them by now,ring them up and tell them you are going to send the bailiffs,if they dont give you the response you want then do it,is it moneyclaim online?

    Did it through the court myself. Have contacted the court who say they cannot advise me and that it is probable that if I enter for a warrant, the bank will immediately retaliate with an application for the judgement to be set aside. So can I get my own bailiff (not that I HAVE one, just that I can try to get one) to go to one of their branches??
    What about asking a solicitor or advice line first. By the sound of it (how you are now feeling) perhaps entering the bank is not a good idea:eek:

    :rotfl: Don't worry - I'm not a madman!!! Just angry. I wouldn't enter a branch unless others thought it was a good idea! I phoned the guy dealing with my case on HBOS's side and got voicemail. I decided not to leave a message...

    Yes, many thanks, am going to go into my local branch to firstly see if I can at the very least cancel the PPI and then get the wheels in motion with my first letter. Many thanks. Will let you know how I get on!

    You will need to read through the policy document first as it may cover you if you are self employed. I am also self employed but the policy I have with LLoyds TSB covers self employment, in exactly the same way as being employed.

    Tiggrae (or/and anyone else who can offer advice)

    I have sent this letter and they are continuing to ignore me. Is it possible for me to privately hire bailiffs to enter their premesis or do I have to use the court appointed bailiff - I ask because I just know that if I apply for a court bailiff to enter their premises, they will apply for the judgement to be set aside. For once, I want to be in control as they have strung this claim out for almost 9 months!!

    there are no such thing as a 'private bailiff' - all bailiffs are court appointed

    If you are self employed and paying catogory 2 NI then most PPI policies do cover when you're self employed. If you're not paying Catogory 2 NI then its likely your policy will not cover you
  • Hi all

    Sent off my first letter to claim back PPI on my Top Man card and had a reply today. They say no chance but they also say they can't find my original agreement but then say that they know I signed for PPI etc???

    Can I tell them to prove I signed it or pay up or am I being too simple?
