    Hello people,
    Hope some one can help?
    I have tried reclaiming PPI from Lloyds TSB for my husband, but as usual there saying that my husband was not mis-sold and there staff do not make mistakes or put on pressure...... my husband was told to take out the insurance because the loan was large amount. About 1 year after taking the loan out he had an accident at work which left him disabled in Feb 2005 we tried to claim with Lloyds but after not receiving the medical records they gave up and then because we were in arrears in November 2005 they cancelled the insurance and paid the rebate of £2000.00 to the remaining amount of the loan which they never contacted us to let us know, can they do this? so now because they cancelled the insurance my husband cannot claim on the insurance.

    Can any one advise on what we could do if there is anything that can be done? thanx

    To be honest, I don't think you should be thinking about reclaiming as it looks like the insurance should have paid out - you needed it, you were paying for it so it should have paid up - what I suggest you do is make a complaint to the FOS about the fact the insurance claim wasn't honoured and that they cancelled the insurance without first asking you !!! You can download a complaint form form the Financial Ombudsman website

    the FOS have just rang to tell me that the ppi element of my complaint is a completely different issue and i would have to send another complaint in about that. I then explained that my complaint about settlement had also other issues with regard to the wage issues and she says that they will be in touch again in a couple of weeks and try to get this fast tracked (for reasons).

    The ppi department is taking months to deal with claims so if after a couple of weeks (I should be ok waiting for that Tiggrae shouldn't I??????) i hear from FOS and they are satified that Firstplus/Freedom Finance acted lawfully (within the law book of Freedom?Firstplus of course) then my only option is the courts as i already know what FOS will say on that one. I have told her that if my views on this loan are correct then it may be different anyway. If someone falsified the income (and we did not as we gave correct details on the application) then would the whole loan of been invalid anyway as this was fraud????? And then the ppi claim would not be applicable.

    I have tried to google the address that they have put in for my husbands wage details but it come up with nothing. There is no name, just an address. I bet they will get away with this one as well.

    did you tell her the date the loan was taken out / ppi was mis sold - it's OK to say send in another complaint, but if it's out of their time jurisdiction they should be able to tell you that now !!!!!!!

    I already know they will say its outside jurisdiction.:mad:

    yes it is - i'm on a half day so i'll print the statement and go in and see them this afternoon to see what happened?

    what if they can explain it away - will my claim be void as its already in process?

    that's ok then - basically, you're only redress against this company is to start court proceedings, if you'de lived in Scotland, dealing with a Scottish based company you would have had to use the Sheriffs court in Scotland which is a nightmare !!! As you live in Liverpool you can start proceedings in your local county court instead

    then start drawing up your particulars of claim for the county court - you've really no other alternative if you want to make a claim for mis selling !

    They will have to explain it or you ask to speak to someone higher still.
