Can someone advise me on time scales for FO decisions i claimed against MBNA in september and the FO adjudicator upheld my claim in March but MBNA have asked for it to go the the FO. I receive very nice monthly letters from the adjudicator saying there is a long backlog of claims how long should i expect it to take? im sure i read somewhere 6-9 months but that should be up now?

Hi I suspect they are correct, most of the independent lenders came under the compulsory jurisdiction of the FOS on 15.01.05 - however, you can still start court proceedings against them within the County Court

Thanks for that........could you tell me how to do that? would I need legal representation, court fees etc..any info much appreciated..

ps still paying finance now and will end jan 2009. ppi was £1111 + £277 charge for credit = £1389.60... monthly that is £23.16....loan term 60 months.
  • Hi Guys

I was wondering if you could help me out a little if possible.

Going over my old credit card statements (I was shredding them!) I realised that I had been paying PPI on my outstanding statements.

I believe I have been mis-sold this for 2 reasons

    1. When I took out the card I was deliberately going to be making myself unemployed as I was going travelling around the world and I told the banker this (at Lloyds TSB)

    2. When I took out further cards with them (after closing and re opening for 0% deals) the insurance was automatically added as I had had it before

Do this sound like I was mis-sold the policies? I have written to the credit card company today to ask for the charges that I have paid since 2004 (when I first took out the card)

I also believe that I may have been mis-sold PPI on my first personal loan with Lloyds for the same reasons as above so have written to ask for information.
I have set a reminder on my phone for 40 days (to keep track of any responses)

From other peoples experiences does it seem that I may have been mis-sold and therefore have a right to claim back these charges?

Thank you for peoples help in advance and hope that everyone is ok. And I would also like to thank everyone for posting on here as it has helped me no end!

Have you now cancelled it? When you told the banker were you then paying it and did not realise and were you then unemployed anyway?
  • Sorry just re read my post and it wasnt clear.
These cards are 4 years old so no longer have them. I no longer have PPI on any of my cards (have a lloyds card again now- they tried to put it on again but I asked for it to be removed. I was told that it was a bad idea but I said I understood the terms etc)

The loan has also been cleared (changed to better % rate)

What reason are they giving for it to go back to the FO? Are they objecting? If they are then does it still have to go into the queue as i read that it then goes to an ombudsman and his decision is then final and not back to the adjudicator. Have you been told this by the FOS that its going to be another 6 to 9 months. I would ask Fos and not MBNA.

Right so you have paid PPI on old cards when in actual fact you were going to be unemployed and travelling the world but you still had this put on your cards when it would of been useless. Am right now???

If so then yes, it sounds like you were missold.
  • Yes that is correct. Same for the loan.
Thank you for that- I thought so but just wanted some clarification.

Now my second question- when I opened a further card with Lloyds the PPI was automatically put on because they just copied my previous applications. Is that further mis-selling or just me being a bit dim for not questioning them about things?

Yes that is correct. Same for the loan.
Then you have done right in asking them to look into the misselling. You will have to wait for their reply now.
