This is for tiggrae as she says that insurance was a licensable activivty in Gib and apparently they were not licensed to do it but note also that Bespoke is now owned by FIDECS. Perhaps they will get around it this way.

I don't understand this law stuff but maybe she can give us Bespokers a bit of info. Fidecs only owned them from 2003 onwards.
In 2003 Fidecs acquired Bespoke Finance Limited, a consumer credit broker marketing into the UK (but based in Gibraltar), primarily as a client facility.0 -

Progress, I have eventually spoken to the person in Gibraltar that sent me the letter from Bespoke FInance and actually he was very nice. I told him that i do not want to be sitting at my computer looking up anything on Bespoke Finance and then adding my reviews (:rolleyes: ). He says that today they have found my records from the archive and they are sending them to Freedom Finance as they have a better compliance team there and they will be in touch. I asked why i received a letter saying he had looked into my complaint when it was obvious that he had not and he could not reply. Just have to wait and see now. I told him my application ommitted it but my agreement had it typed in and 40 months were added.
If they cannot find anything to the contrary of my not asking for the ppi to be added then i wanted to make my claim for all the ppi and interest and the difference between settling the loan over 120 months (like i asked for) and 160 months. He did ask what i wanted from them and i said putting back into the position i would of been in if i had not taken out the ppi.
I also added "did you actually sell the insurance" and he answered "well yes through Freedom Finance". I then added either you did or you didn't and then i mentioned about being in touch with the FSC in Gib and he did not seem too worried. I told him as i not even heard of this company i needed to find out as much information as i could.
He did state after he asked what i wanted that "we had no need to be regulated."
Also i asked why it was not made clearer that our source of application was in Gib and he stated that "i know it only says it in the smallprint but you are getting your loan from a uk lender." I then told him that when we had a complaint about the ppi side or the setting up uk lenders then tell us "we did not sell you the loan"0 -

Well done you for getting this far Marshallka. If you will now be dealing with Freedom Finance. They were not regulated by FOS. Don't know when you took out your loan, but we took ours out in May 2003. They were members if FISA. The Compliance department at Freedom Finance were not good. As at the end of the day I had to take them to court.
Keep at it. They will fob you off. Threaten them with court action when they write and tell you they are closing your file, after they have a thorough investigation!!!! Ye right.
Just go for it and don't give up. You have come a long way.
You don't want to go to Gibraltar - its full of monkeys!!!!!

Hi Marcluc i posted a few pages earlier about our ppi with igroup/ge money. Initially our loan was taken through Freedom Finance. On your paperwork was the 'optional' box ticked when you got it? Ours was and im unsure whether we will get it back? We too were told we needed the ppi.

Yes ours was pre ticked too. However, my argument also included that it was mis sold as: the PPI only applied to me - our loan was in joint names, it only covered 5 years, not the full term of the loan. Also FF said I signed the form, so I agreed. My argument for the court case was- over reliance of documentation sent through the post - we would not be expected to understand it all. I also quoted the case of Howard maine v A Ogden 1975. Also PPI price far exceeded what is reasonable as required by supply of goods and services act 1982 S.15

Have not had the chance to read right through the threads yet, but regarding GISC, does anyone know if Endeavour were regulated by these in 2004 ?

My complaint is in with the FOS, was sent in over a week ago, but even though its early days I have not had a reply yet, but the final letter from Endeavour states that I cannot complain to the FOS about them because they were not regulated by the FSA, but if they were by GISC then I know we still have a chance.
