PPI Reclaiming discussion Part II

Just rang the FOS and asked whether they are looking into the ppi bit of our loan and I told him that we were going to take it the court route as it was outside their jurisdiction and they told me to hang on. Apparently it has not been assigned to an adjudicator yet but i did stress about the limitations act and he still said "hang on". I then said that Firstplus were not GISC regulated at the time and he said "they were when you still had the policy in 2003" so I now do not know what to do. They have requested everything from Firstplus that they hold about the loan and policy and are waiting for this information from them. I am so in limbo here. If i hang on and then they say "sorry we can not look at the ppi" i may be outside my limit for making a claim. They have said that it takes 6 to 9 months to settle these claims. I did mention again that we need to start court proceedings and he again said "hang on, thats why we are here". I don't trust anyone do I.
I was told when i called the FOS and when i emailed that it was outside their jurisdiction. Now they are saying to hang on.They sent a claim form out about the "settlement" as they said that was something they could look at and i added about the ppi on there. Maybe they know I don;t stand a chance and don't want me to waste any more money.

I've actually used some of that in a previous letter i sent directly to first direct. It was very useful.

I've only just sent the SAR request - I was waiting for Mum to dig out her paperwork and send it to me so I had account numbers, etc.
There is a surprisingly small amount of 'official' paperwork - just copies of the agreement and charge on the property, and a list of sums for consolidation.
Most of the bundle she gave me was paperwork my parents had supplied to support the application - wage slips, marriage certificate, utility bills, etc
So, I'm hoping that Endeavour/Norton can provide a lot more info to give us a better picture - and most importantly, the tapes of the application.
I'll keep you posted, as I'm sure I'll need help with this one. From reading other posts, Endeavour don't seem the easiest to deal with :mad:
The good news (which I should post in the success thread) is that I've claimed back over £3K in PPI applied to my Dad's HSBC loan and £460 from the Accident Cash Plan applied to his Marbles credit card (they had no proof he asked for it, and I wouldn't take no for an answer)

Hi am only popping on for a little while as am on holiday at the moment with my wife and son. You don't require your original paperwork as long as it doesn't differ from the paperwork that will be submitted by the company in defense of your claim. When or if they file a defense, then this should include a copy of the original agreement. I would heartly recommend sending off the SAR to redeem the rest of the paperwork relating to your policy unless you have enough evidence with the corresponding photocopy and reference the acts and regulations in which it was is breach of.0

Maybe they know something new - phone them back and ask them what happens if it goes over the time limit while you are waiting?LTSB PPI - £770 ish for dad
