Hi does anyone know if its ok if i havnt got my original paperwork for when i go to court? i have only got the photocopy will this matter? its been over 6 years since we took it out so we paid it off 2004 and didnt keep the paper work as we didnt know about this reclaiming till a few months ago, m colak where are you?

Hi am only popping on for a little while as am on holiday at the moment with my wife and son. You don't require your original paperwork as long as it doesn't differ from the paperwork that will be submitted by the company in defense of your claim. When or if they file a defense, then this should include a copy of the original agreement. I would heartly recommend sending off the SAR to redeem the rest of the paperwork relating to your policy unless you have enough evidence with the corresponding photocopy and reference the acts and regulations in which it was is breach of.

    Hi

When should I send my first letter off to Picture to get this ball rolling? We are due to be repaying the loan in a couple of weeks (sold the house) but should I get the letter in first, or pay the lot and then try to claim it back?
YOUR = belonging to you (your coat); YOU'RE = you are (I hope you're ok)

really....it's not hard to understand :T

Its purely up to you on that but look at this way if you settle the loan first, before the completion date, then you might be penalised financially. I would ask for a settlement figure and see if it seems resonable before considering settling else you may have to chase them under a disproportional rebate. Also if you sort out the PPI this could come off you loan and significantly reduce your final settlement figure. Its in reality a trade off between interest saved on the loan (if not a single premium policy) or interest saved in the bank.

Update on the wifes Debenhams card fiasco.

Sent them a letter yesterday saying if she ordered the protection on the phone then can we have the tapes. Then last night I can't believe what happened.
The wife got a cold call on the phone asking her if she wanted to have insurance on her, yes you guessed it, Debenhams card. She obviously said no but I can't understand the logic behind their call. Surely they wouldn't sink as low as trying to get her to agree now and then use this call as evidence. This lot are unbelievable.

I sent the 3rd letter to LTSB for my dad on Monday - he has now paid off the loan but we are claiming the PPI back under mis-selling - he got three! yes Three letters yesterday asking him if he wanted a loan!

Gosh....mcolak...thanks for taking the trouble to reply. We already have our settlement figure and, out of the £11,227 PPI (single premium), they have offered us a rebate of only £1,200. Problem is, I think this is going to drag on and we have to settle the loan......don't we??

Is it legal to withhold the whole amount that (they say) is due to them ie. £56,500 (to include the PPI) or can we hold onto the total saying it is in dispute??

    All opinions greatfully received.
