The Consumer credit act is a big act...
I thought because the ppi is a separate amount and below £25k it would be part of the cca but its not its all one loan.(unregulated)
Consumer direct said regulated loans would have been 2 separate agreements. Unregulated they could arrange the agreement any way that suited them sceaming rats something like that anyway:wave:0 -

I just called ombudsman to ask a question and as soon as I mentioned ppi 2004 they could not help me. :eek: :mad:
Called consumer direct about the ppi query and he said they would probably class the loan and ppi as one. mmmmmm He was quite lost think I throw to many questions at him poor thing lol Think he was glad when I said goodbye bloke probably needs a drink now lol
The problem here is they know they have done wrong and send everybody around in circles to avoid the truth.
Did you get the loan through firstplus sorry if you have already stated this.
I should not have lost it here with him and I am disgusted at myself really but he really got me mad by telling me different to the Ombudsman and Iam totally confused as he is a complaints manager... He should know these things shouldn't he. He knew he was misleading me, I cnnot prove it and that is where its frustrating. No-more calls from me now. I am not safe...

You are being treated appallingly here. I am just trying to scan copies of my unmentionable letters here in the hope that they may help you in some way or the other so will e mail them to you cause they go into the ins and outs of a donkeys bottom. I know if not the same but may help:mad:0 -

Think the guy was trying to say if I had 2 separate forms one with £40k and a separate one for £9796 ppi then the ppi may have come under the cca.:wave:0 -
please advise.. took loan out 2006 with barclays over 60 months. last year i asked to cancel ppi was told i had to apply for another loan to get any refund, i didnot bother. then i read article on website, i rang barclays they told me to go into local branch and they would help!! no they didnot, they told me the same thing.
loans today are hard to get and more expensive no doubt.. besides experian changed their scoring to suit credit climate that helps lenders to not lend good on you experian no wonder people are in trouble. please can anyone advise i cant take out any more loans, all i want is a refund for mis-selling it to me in the 1st place or reduce my payments so i can pay my debt abit easier.barclays have lodged a complaint whether that will help me i just dont know that answer.0 -
Just been to companies house and for a £1.00 brought a copy of Picture Financial Services Statement of affairs!
List of people they owe money to and a few must be Jo Public who won claims.
Looking at the figures if they are not declared in default by Christmas I am getting a job at the FSCS and dealing with my own complaint!DS1 12/10/04

Yes you should be able to cancel and it is normal practice for them to give you a new loan. It should be at the same interest rate or less as the original loan. I do not think it should affect your credit score.
The banks have something called Treating Customers Fairly. Tee Hee that is hilarious!
Alternatively if you think you have been mis sold look at main web site for more information on this. Then you may be able to get the PPI back. Barclays loans are usually front loaded and that on its own is usually enough to be able to make a claim. There are template letters which I am sure Di will give you a link for.

I would put everything in writing to Barclays about your complaint, you need to try and resolve it through their complaints policy first before you go anywhere else with it. You could also request all the info and calls (if done over the telephone?) they hold on you SAR for normally a fee of £10.:wave:0
