Exactly, I agree with you hun.
For instance my broker was Click Finance who arranged my loan in July 2004, although they run many companies this actual one dissolved in 2005, annoying really because the actual director of that company will not take any responsibility for mis selling, and say they are unable to help due to dissolving...... , anyway the lender which was arranged by Click are Endeavour, and I have this one in with the FOS right now, the 2nd time round, and like Marshallka's I am expecting this thrown back to me.
I have in the meantime emailed the FOS who are supposed to be checking on this for me, I had asked them if it were them of the lender or the insurer I should be dealing with due to the unfair rebate settlement matter - now just waiting for a reply.
They are sending me on a merry go round and I am now making a complaint about the way they handle complaints to the FSA and OFT and their fitness to continue trading at all. (although they have stopped trading now!!).
I feel so annoyed at this and want something doing and no-one can go near them. Can I make a complaint to the Ombudsman about their handling of this.?? I want to...0 -
marshallka wrote: »Dying to hear your reply to this one. I rang firstplus today and spoke the complaints manager and he told me that my complaint for the unfair rebate was against the BROKER and not the lender. He said that the rebate was explained to you by the broker. I then said that the complaint was against the rebate received and the rebate received was because of a "term" in the policy that was underwritten by the underwriters. I then read the email out that I had from the FOS to me to state my complaint against the insurer. He then said he would get my policy and then told me to write to Miller Firstline. I then told him that Miller Firstline liquidated in 2003:rolleyes: . He then said well you write to each of the consortium of insurers.I then asked him sternly for an address of where I make the complaint and he said he would get back to me. He has not and will not either as he says he has stopped responding to me as this complaint is now with the Ombudsman. (although it is not as the Ombudsman have closed the one he knows about!!!).

Yep this is disgusting and I have never ever come across anything like it in a complaint like this one before.
Being pushed from pillar to post........ .
I would do them all for not treating you fairly, this is absurd........
You have rights to be treated fairly and none of these have been that !!!
I was in fact thinking the same, maybe the way this case has been handled, you may have rights to have this looked at by the FOS, I know I would be tempted !The one and only "Dizzy Di"0 -

I am waiting for the ombudsman to get back though first before sending this letter as it looks like if they were not members of the GISC then would they be under this compulsory jurisdiction of the ombudsman.

Just received this from the Ombudsman in regards to who to write to.Thank you for your email below. Further to your conversation with A*********, I have made contact with Firstplus to request confirmation of who the underwriter was for your PPI policy. I will contact you as soon as I have received this information. In the meantime, I thank you for your patience.I couldn't help myself and rang firstplus today to ask who the insurer was and they told me to write to Miller Firstline as stated on the policy. I then told him that they went into liquidation in 2003 and he told me to write to the FSCS then. I was so annoyed then. I asked again who underwrote the policy and he said the list of the 3 or even 4 if you include the life insurance. I then rang Lloyds and asked for syndicate 582 and they gave me a number for Cassidy Davies. I then rang them and they told me to make my complaint to them in the first instance as Miller Firstline was dissolved. They told me that although I have complained to them that they would then pass the complaint to Lloyds and then Firstplus would correspond to all this.I am now going to make another complaint about the way I am being sent around in circles with this complaint. Its so ridiculous but I cannot send this letter yet to Cassidy as the Ombudsman has asked for my patience in this matter.I have no patience left. It went some months ago..
Just called firstplus as I have no patience either lol they told me if I complain to cassidy davis they would just direct me to freedom whom sold it.
I explained that freedom are a waste of time and have wasted my time also. mmmmmmmm:wave:0 -
This is an extract from 2003 before the regulation of insurance by the FSA and yet this complaint was upheld against the insurer.
04/03loan protection – eligibility – self-employed insured on ‘maternity leave’ – whether ‘actively working at her business’. TOP
Mrs M was a self-employed dietician for a dieting organisation. After the birth of her child in February 1998, she did not return to work for some months. In June 1998, while she was still unemployed, a lender telephoned to offer a loan to her and her husband, who was in full-time employment. She was also offered insurance to cover the repayments and she agreed to take out both the loan and the insurance. The paperwork named only Mrs M as the borrower but she did not consider this important.
Mrs M returned to work in September 1998, but was offered less work than previously and her earnings were only £12 per week. Her husband fell ill in November and was diagnosed as having a brain tumour.
When the couple put in a claim for disability benefits, they were told the policy did not cover him. Mrs M contended that when the policy was sold she had provided full details of her husband’s earnings and her own status, and had discussed the recent birth of their child.
complaint upheld
It was up to the insurer to prove that the policy had been properly sold and that the sale complied with the provisions of the ABI Code. The insurer was clearly aware that Mrs M was both self-employed and on ‘maternity leave’. Since she was not ‘actively working at her business’ she was not eligible for the policy. However, we did not consider that the insurer’s refunding the premium constituted an appropriate resolution of the dispute.
We accepted the insurer’s contention that the policy could have been transferred into the husband’s name at Mrs M’s request. However, we did not agree that her failure to make such a request meant she had deliberately chosen not to take out cover for her husband. We were satisfied that the policy had not been properly explained at the time of the sale.
The appropriate outcome was for the insurer to amend its records to include the name of the husband on the policy and to meet his disability claim0 -

I explained that freedom are a waste of time and have wasted my time also. mmmmmmmm and that i need to seek independent advice
Just thought I wonder if the ppi on the loan is part of the consumer credit act as it was for £9796k and this is the only part im complaining about?:wave:0 -
marshallka wrote: »Angelwillow, I thought it was a misselling of the PPI that you were after. I don't know if the settlement is ok or not. I thought you had settled and gone for the PPI back and wanted to know how much you paid..but looking now settlement looks fine..
Sorry for confusing things. I am in touch with them about the ppi as they didn't tell me it was optional. But looking back at the paperwork I was just wondering if I had received the rebate that I should of when I paid the loan off early - just curiousity on my part as I had no idea how it was worked out and just took their word for it.
Thanks for your help anyway. :cool:0 -

I know this company has stopped trading and I want to make a complaint against this person so bad as he has knowingly sent me on a wild goose chase today and told me I had to make my complaint against Miller FIrstline and if they are no longer trading then take it to FSCS. I told him I was going to make a complaint against him to whoever I could and he just said "i can handle a complaint against me" so cocky.
He misled me and he knew it and treats me like a little person against his big firm. I swear I want this person taking out of the complaint section and its the only person that they allow me to talk to. Firstplus now have no respect for their customers and certainly do not treat them fairly as they do not trade anymore and it won't be long before they are closed down. The sooner the better I would say. Barclays tried to sell them even for a loss just to get rid and I don't blame them.
I have complained and complained and it was these that took the michael out of me for not saying the word of "ombudsman" right when I first complained and they all laughed in the office. I feel this company is the worst company to ever have dealings with and I really do hope and pray that they are closed forever soon. They have ruined so many lives and do not realise it. They lie and cheat and continue to do so now.0 -

I got told this by someone some time ago.
They said concentrate on the loan that paid the PPI and not the PPI itself. The loan is part of an agreement under the CCA.... hmmm got me thinking.
What are you thinking here.
The Consumer credit act is a big act...0 -

He told me that after saying that it was dispicable and put the phone down. I know I lost it cause of this phone calls here and letters here and emails here. I was wrong in a way but I do hope this company closes down and I know they have made lots of staff redundant already and I just wish he was one of them as he treats me like dirt and when I ask a question about something he will not answer:mad: . I thought you were allowed to complain to companies.

I know its not funny marshallka but well done for you i'm sure it would have got some fustration out. They are pathetic little rats. They all deal from the gutters lol
I just called ombudsman to ask a question and as soon as I mentioned ppi 2004 they could not help me.
Called consumer direct about the ppi query and he said they would probably class the loan and ppi as one. mmmmmm He was quite lost think I throw to many questions at him poor thing lol Think he was glad when I said goodbye bloke probably needs a drink now lol
The problem here is they know they have done wrong and send everybody around in circles to avoid the truth.
Did you get the loan through firstplus sorry if you have already stated this.:wave:0
