Hope you don;t mind me dragging this one up bathgatebuyer. It may help others on here with complaints that get thrown out of the FOS complaints procedure....:D

Please note though you are only allowed to go for this if they do not produce a CCA with all the prescribed terms on if the agreement is still in force at the time... ie an executed agreement.

ALso complaints about executed agreements come under Consumer credit complaints and FOS only had juridiction of these complaints from April, 2007 and the agreement has to be on or after 7th April, 2007

Our remit over businesses with a standard consumer credit licence only covers complaints about things that happened after 5 April 2007. Quite a large proportion of the enquiries we received at first concerned events that took place before that date, so they were not matters that we could help with. That is less of a problem now, and we expect numbers to build steadily as we go forward.

If anyone has a consumer credit complaint about an agreement since 7th April, 2007 then you can take this complaint to the FOS and this is anyone holding a CCL and not just about companies under the FSA.

The FOS are looking into no credit agreement sent from La redoute and trying to default me even though I was still paying. The agreement started in 2000,
    is this the same thing?

Yeah I know, it is disappointing not to hear before the 8 week deadline, and I do hope this goes all in your favour when you do hear.;)

Sorry I missed that you had already wrote to them.
Now hun, are you interested in requesting a SAR from them if you have not already done so ?
This one they cannot ignore ?

Yes we need an address but we can always look up their compliance office who should deal with this.

Tomorrow ring the FOS and tell them that you are having a problem filing a complaint with Egg and that you want the FOS to get in touch with them on your behalf.

What about if I wait to see what freedom come back with and then submit a letter stating it is a new complaint based on the other things that have just come to light with the ppi? Any ideas
You could always try but bear in mind what I have said... they may not even reply to it and you are losing time again here...

That is certainly not treating customers fairly by doing this. Make a complaint to the FSA and also the OFT...

Marshallka, can you clarify the "things that happen after 2007"

As I think that although my credit agreement was 2000, their failure to supply it etc was after 2007 which is why they took it on, is that right?
