Found this website you can actually check to see if your credit agreement has any flaws, (under maintenance at the moment but worth looking at when its back on). Free to use it:

There have been some posts on here about unenforceable Loans. PLEASE PLEASE be very aware of these companies. If they are asking for money up front do not go along with them. Some ask you to pay up to 500 just to check your details for credit cards. If you have settled your CC and are looking to get money back I think you will not be able to claim that they are VOID and that is because you have settled them.

Be aware. If you go down that route please look around and get as much info as possible:eek:

For newbies please note that we often get SPAM on this site of people coming on just to sell their companies or getting a commission so again be Aware

Do you know what Dreamer and I know Marshallka will approve of this too, but if we all done something and all wrote something to these regulators, maybe the more the better would be good, I know there would be thousands on here that would back this up.

Marshallka if your reading this hun, what do you think ?

What if we all write to these regulators to help push the boat a bit here due to Dreamer's post above ?

Or some sort of petition, I am not sure how to go about this but there must be a way, and for us to sign?????

    For example write to the

    FSA
    OFT
    FISA
    FLA

And so on, this needs to be recognised, and I am also a member on other sites, like some others here and the more we can get to do this the better, what do you think ?
Di, I wrote to every single one back in April. Nothing was ever done, I did ask for everyone to do the same too. It made me so ill back then. I just felt so alone and told them that i felt this country had not looked after me as a british citizen but all the reply I got was there was always the courts for me use. I also got told we had always been protected but by the law and if I felt that strong and knew I had a case then to use the courts.

Don't know really whether this would do any good but worth a try...

Yes the more people that write to them they really should be looking into this. I believe we all have rights no matter what year we do something.
We have always had rights. The courts and the laws of this land.

We still can use the courts for pre 2005 complaints if the companies did not come under jurisidiction but it costs money. Most are frigthened of losing more and also even in the small claims courts these companies use powerful solicitors to fight us. This is where it is wrong. They have lots more money than us..... mostly gotton from our PPI...

    Folks

Don't know how many of you who are fighting firms who were not covered by either GISC and the FSA, but as you know due to this reason is why we are being fobbed off with our complaints. They know they can get out of it, although I did get lucky with a complaint which was not covered and they paid out within 3 weeks, but its very very rare this will happen.

However, if you have read Dreamer's post above, you will see Dreamer has wrote to all the regulating parties of why this is so unfair, at the end of the day we were mis sold and ripped off with our money, no matter the dates, its discriminating !

I feel rather bitter the last few days, due to one of our members who is always here to help others win their money back and yet she is let down big time with her's due to the firm not being covered.
I am rather bitter with the FOS.

This member is Marshallka, she is here for everyone and will get right to the bottom of making sure others are helped, Marshallka is very hard working and is always here, she never fails in answering every post she can.

Now we all need to start getting tougher with this and we need to be heard by all regulators.

If anyone thinks its a good idea, we could all try to work on this together, this needs to be recognised, the mis selling of PPI is a BIG issue these days, and its about time this came to an end, but these firms continue to do so !

Anyway, if anyone has any ideas on how to go about this for this to be recognised we could stick together and do something.

I am up for it, and I know those of you who were let down will be too, also others not in this situation to back this up and support us here.;)

(Oh and thank you Dreamer, you have started something good here) lol. x
Ahh thanks for that Di...:o :D

Shame to hear that and I know I signed being a member here back a year or so ago here but only started posting regularly over the last few months.
I would have backed you up all the way.

Dreamer is also waiting for a reply from Wendy about this and it will take a load of us I know and to keep on and on.
I am not saying this will change anything but maybe its worth another try.;)

If all these reclaiming penalty sites agreed to this too, it would be a great help.

Have sent the below message to MSE WENDY, will let yous know the outcome.

    Hi

I was wondering if you or Martin could offer any support or help to the members with regards to the mis-selling of PPI.

The problem is many of the people on this forum have encountered problems reclaiming their PPI, due to the fact that the companies involved were not regulated, knowing this they are getting away with not paying out. However successes only come from companies that were regulated.

I have sent the below letter to all the regulating bodies, to bring this to their attention and just wondered what your thoughts were for every member having a problem to write to them or any thoughts on how we could all campaign for the people having PPI prior to 2005.

    PPI mis-selling

I write with regards to Payment Protection Insurance and that I have complained to Freedom Finance about, to no avail, due to the fact that we feel we have been mis-sold the PPI.
Although the loan was taken out in 2004 and the fact that they were not regulated, I know you may not be able to help, however wanted to bring this to your attention. I also believe even though they were not regulated that I should have the right to have my complaint investigated fairly under the Human rights act 1998.
I do not think it to be fair that anyone with a loan taken out in 2005 should be treated any different to a person taking a loan out in 2004, even though Freedom Finance were not regulated in 2004. I know of people who were covered by the relevant regulating body and have received funds back due to the mis-selling of PPI, but what protection is there for the people prior to 2005. It does not seem just".

Any help would be much appreciated.

    Thanks
Dreamer, I did the same here too and was told we have always had protection by the law, its just we have to use the courts here. There is always the mispresentation act of 1967 or the Unfair terms in consumer contracts 1999 etc. You may have to think now about using the courts. I know of two that fought Freedom through the courts and both won at the last minute and did not have to attend the hearing...

    Hi Marshallka

Glad to see you on here. People are feeling impotent on this site and I think feeling very protective over you cause of all the time you spend helping others. We can only keep trying sometimes in life if you do not challenge systems they never change and we can only keep trying.

    Take care;)

    Hiya all,

I had a loan with Paragon and paid it off early. I've received a copy of my paperwork off them and think I should be able to claim back for the PPI, I'd just be grateful if you could check it for me:
    • Loan amount: £35,000 (1st payment 1/11/04)
    • PPI added on top if this: £7,175
    • Total amount of loan & PPI: £42,175
    • Interest at start of loan: 8.9%
    • Loan was over 240 months
    • Final payment: March 2006
    • Loan was paid off March 2006 (after March's DD had come out)
    • Number of months paid: 16
    • Balance at this time: £40,977.61
My final settlement figures were made up of the following:
    • Int. retention release (Debit of £9.66) (Balance £40,987.27)
    • Early redemption interest (Debit of £1,763.58) (Balance £42,750.85)
    • Rebate credit prot. ins. (Credit of £852.06) (Balance £41,898.79)
    • Administration Fee: £150.00 (Balance £42,048.79)
    • Cheque receipt: £42,552.49 (Balance £503.70)
    • Refund BGC (After redemption): £503.70 (Balance £0.00)
I have no idea what the "refund BGC" thing is, I just paid what they stated.

Now, I think that as my original PPI was £7,175 and they refunded me £852.06, my PPI refund now should be £7,175-£852.06 = £6,322.94.

Does that sound correct to you?

    Many thanks for your help!
    PPI element 17.01%
How much were your repayments.???? you have written 368.46 so this cannot be worked out as 368.46 x 240 months is 88430.40 for the total loan and none of the figures above use this amount...
