Marshallka is this any good to you at all ? If needs to be........
http://www.financial-ombudsman.org.uk/about/IA_terms_reference.htm
Check it out and see what you think, someone had mentioned these as they could not have one of the complaints checked out and left this link, so I thought I would post it here.;)
I feel so angry and my husband has just read this and like he says, they have definately had something from the FOS with regards to the other loans as they has responded by this goodwill gesture on it.
Also, FOS have stated that they know we had "one other loan" There were 4 in total and they have this written down everywhere. Why don't they bother to actually read things when they are this important. We have all learn't the hard way of reading things properly on our loan agreements.
I am annoyed cause it was not my fault the adjudicator went off ill for 5 weeks.0 -

2002 £2673.39
2001 £1709.44
1999 £1777.19
1997 (ONLY GOT AGREEMENT and doubt they will look into this one although don't know yet...I can only but hope but probably another £2500 to £3000.)
These figures include the statutory interest too. I did request this but with the adjudicator being off work I bet they have not asked for that and they already have the offer??
Looking at that an offer would not be accepted below £6K if they say they have looked at the 3 above. Have to wait and see.
The one on my complaint form orginally sent to the FOS was the top one of 2002. The others were mentioned in my complaint explanation thing.
They have offered to repay the second one down that was the lowest... .0 -
Dates below
Loan taken 23/12/02 settled 26/07/04 loan £8100 PPI £2588.84 (ORIGINAL COMPLAINT)
All the others below were mentioned and I did also complain to the co-op about
them.
Loan taken 10/04/01 settled 04/08/02 loan £4000 PPI £1278.44 (the goodwill gesture loan)
Loan taken 17/08/99 settled 21/01/01 loan £9000 PPI £2068.75
Loan taken 09/07/97 settled 1999 loan £5000 PPI £1144.77
If I accepted this goodwill gesture then it is £1709.44 of the £8K plus that they owe me if found to be missold.
I have all the details of 3 of the loans and how much the rebates were and also all the statements etc. The only one that they could get away with is the loan of 1997 as I do not have the statements for this one and also the rebate against the PPI.. I have got the agreement though..all that the adjudicator asked me for was the actual agreement and said that would be enough.
What I am owed on them
2002 £2673.39 (Got all details from co-op including statements)
2001 £1709.44 (got all details from co-op including statements)
1999 £1777.19 (got all details from co-op and have settlement letter stating insurance rebate etc myself as co-op did not provide the actual statements for this one but I have a letter of breakdown of settlement)
1997 (ONLY GOT AGREEMENT and doubt they will look into this one although don't know yet...I can only but hope but probably another £2500 to £3000- the adjudicator asked if i had the agreement today and i have sent it to him.)
Total owed including statutory interest £6160.02 plus the one of 1997 perhaps another £2K + with stat interest so at least £8000+ owed if missold.
They have offered to redress the one totalling £1709.44:mad:
THE ONLY LOAN THAT PROBABLY COULD HAVE BEEN TO REFINANCE ANOTHER WAS THE ONE OF 1999 COULD HAVE BEEN TO REFINANCE THE 1997 ONE????? DON'T KNOW FOR DEFINATE....ALL THE OTHERS WERE COMPLETELY SEPERATE AND HAD BETWEEN 3 TO 6 MONTHS INBETWEEN.0 -

Loan taken 1997 settled 1999 loan £5000 PPI £1144.77 ( I think this one was then consolidated into the one above of 1999)
Here are my dates again..

Accept the ONE that they have offered if you agree with the figures. If they were re financed. First three seem to be if so do not accept this figure cause if the second and third was re financed from first they owe you PPI from first loan and second loan that was then added into third loan. The fourth seem to be stand alone is that correct. Sorry have not been able to read through all.:D:mad:0 -

Hi,
I wrote to the FO in May 2007 to reclaim my PPI from Citifinancial as I had said that I did not want any PPI insurance. They took my case on in Oct 2007. In Feb 2008 they wrote to Citi and agreed that I had been missold the insurance, as I did not have a mortgage to pay, no independents and I had privite insurance from work. FO adjudicator told them they had to repay all what I had paid plus interest and also pay me the PPI from the 1st loan I got off them (which I never asked for) FO say that Citi were in disagreement and said that I had signed for it.
FO wrote to me in June 08 and said that it was being passed on to the FO final decision and that if they agreed that citi missold me PPI they would have to repay it back to me.
I received a call from them in Sept, they said that they had taken it as far as they can now and that they would close the case for now and would call me in a few weeks time (or I'd call them if I heard anything) and they would re-open the case if anything else occurred.
Is this the normal procedure?
Can anybody shed any light on what the procedure is? hope somebody can be of some help.
Thank you for taking the time to read this.

Usually it goes to an adjudicator and if its upheld by them but the firm disagree then it can be another adjudicator. If this is still upheld and the firm still disagress then it is the actual ombudsman that makes the decision and his decision is final and they then have to pay you back. (providing the ombudsman agrees with the adjudicator)
Sometimes it is just one adjudicator and then straight to the Ombudsman for the final.
All this can take a few weeks or even months from what i hear.0 -

Hi there
I take it this case has now been passed on to the ombudsman himself now then from the adjudicator ? If that is the case, this can happen if the loan company are still denying mis selling, this happened to mine with nemo personal finance, the case was with the FOS in Oct 2006 and we finally had the pay out in Jan 2008, it was very complexed, but now that your case is upheld anyway, the FOS is very highly likely to agree with the adjudicators decision.
Sometimes it can be 2 adjudicators then the ombudsman.
Unfortunately, these can take time but I do think you will hear soon.;)
Did you have 2 loans with these then ?The one and only "Dizzy Di"0 -
marshallka wrote: »Maxdp, none of these were to refinance the others so all completely seperate.(i have now added the actual dates). There was about 3 to 6 months in between. Maybe (as I can not find the date of settling??) the one of 1997 was refinanced in the 1999 loan.
Ok well accept them one at a time as they make the offers. There is not saying why they offer them in the order that they do just knock them off one at a time. Tick the box and go on to the next one. In my humble experience with FOS they do not push or sort out they are like counsellors they just mop everyones brow and try to keep the peace. Am still waiting for mine to be sorted but now take a laid back attitude cause I know whatever stress I get in it is not going to make any difference.
I say that but just wait till I get pi...d off again I shall be ranting and raving on here.
Am not going to PM cause you know what I am going to put in it but do not have concrete evidence at moment to back it up so am not going to advertise.:mad:0
