PPI Reclaiming discussion Part II

From the start of when he opened the card accounts, I suppose the earliest would be pre 2000 around 1997, as I say it's only since his income fell drastically that he had trouble meeting monthly payments he assumed ppi would kick in and help but it didn't apply unless he was out of work full stop. How they expect you to cover usual minimum payments whilst on jsa I'll never know???? He isn't out of work just not earning enough, he is in the building trade and we all know how belly up that has gone recently.
Sorry I thought it cost £10 per time to ask for a full statement of all charges, interest etcDMP support thread member 211 :cool:I'm only here to get some medals......honest!0 -

My OH is self employed, doesn't own his own business but works for someone else. He has a loan with Halifax and ppi was included as he assumed he was covered when he couldn't meet payments, however since we were having difficulties meeting the minimum payments we assumed that this protection policy covered his payments.
I just wanted to ask if he had a chance of claiming back ppi even though it is tied in with a loan? I think this would be cheeky but after reading about ppi on several sites it seems this is a grey area and not many people have a successful claim with it anyway, making it virtually useless especially if you are self employed.
What are the first steps? request a CCA to see if the box was ticked or send a template letter? He is on a DMP too.
thank you0 -

Its so annoying isn't it hun ?
Right I think someone else here may have to confirm this one to you as you state they were pre 2000, and maybe if it were your bank it could be okay, although I would like someone else to confirm this.
However, it maybe still worth complaining about and still try to reclaim, because of course he was still mis sold, where if this was after 2000 then I would say there would be no problem here.
Have you any credit cards after the year 2000 hun do you know ?
Do not take my word on this at the moment, but maybe you will still be able to reclaim on this but as they were prior to 2000 - earlier it would have to be checked if the FOS could actually look into this if needs to be.
So please just look out for other postings here where this will possibly be confirmed to you.;)
Edited to come back in :
Thanks Tiggrae for coming along. The one and only "Dizzy Di"0 -
you problem you may have in reclaiming against Credit Cards is the length of time the PPi was 'sold' on them - ie outside the 6 year stated within the Statute of Limitations Act 1980 - who are the Credit Cards with ?
Thanks for coming along Tiggrae, this one I was not certain about so cheers hunni.:DThe one and only "Dizzy Di"0 -
His employer pays his insurance and tax etc and the cards are with Halifax, Monument, Barclaycard and MBNA
He actually phoned one up (MBNA) and said he would have trouble meeting payments, the woman on the phone said can't help because your account is not in arrears, he asked about the protection but was told it was only for being out of work.DMP support thread member 211 :cool:I'm only here to get some medals......honest!0 -
