I am going to contact all my creditors in the morning to get outstanding balances and APR's, still havent found any letters from courts which may indicate a judgement against me and the pile of unopened post is now nearly cleared. If I contact my local court will they be able to tell me if I have any judgements against me or any summons against me? Seems you are getting the right advice here but just one more thing if you do want to keep your finances seperate from your husband and protect his credit rating,you can do just, don't take out any joint finance or open any joint accounts as this will immediately associate you financialy0

Just don't let them in, they have no rights of entry. If there was court action against you you would have found letters by now, they would send loads before it got to that stage. You can get a free 30 day trial access to Experian credit reference file for you which will show you if any debts have got to that sort of stage - sign up via quidco and you will even get paid for doing it!!
Well done for geting down to opening them all, it does take a lot to do it but you only have to do it once and then you can get on and deal with it all.
When you speak to each creditor don't let them bully you into making any repayment plans now that you can't afford, just be firm with them and tell them that you are sorting everything out and you will be in touch in a few days.£34,547 (Dec 07); Current debt: £zilch (Debt free December 2010)

Didnt get to bed until 4am this morning after finally sorting tackling the mountain of paperwork I have been avoiding for the last three months. Didnt make pleasant reading, when I finally got to bed I dreamed of balliffs and debts.
Decided before work this morning I would phone the local county court and the magistrates courts to see if they could help - my way of thinking was if it was baliffs then they have to apply for a court order therefore it would be listed on their systems.
After phoning the county court I felt optimistic - there was nothing listed with them. Phoned the magistrates court who confirmed the same, but then went on to tell me that
A) Baliffs dont HAVE to apply to the court for a walking posession
(so it may be a baliff they just didnt apply for a walking posession)Reputable baliffs will send 2 or 3 letters warning you that they will visit if you do not make arrangements to pay debts owing, if they then call and you arent home they will leave calling cards.
(I wasnt left any calling cards which indicates the unsavoury type of baliff)
C) A CCJ wouldnt neccessarily be registered at my local county court it may be at the creditors local county court.
(Pointless phoning the local courts then)
The only helpful thing they had to say was, whatever you do do not let them into your home - if you allow them to value your belongings then you continue not to pay they can break into your ome and take them.
Now I sorted all my paperwork last night - I have NO letters from any county courts. I do have letters from debt collection agencies threatening ccj procedures if I dont make payments of full balances.
I havent phoned my creditors yet.
Whats the next step for me? Do I contact my creditors and inform them that I can no longer pay up and tell them that I am sending a soa with a payment plan or do I contact somewhere like cccs who will arrange a payment plan for me?
This is causing me so much worry, I wont answer the phone in case its creditors and I am sat in my home with all the windows locked and my front door deadlocked, bolted and chained without the tv on incase they come and hear it. I am 4 months pregnant, with a 2yr old son and getting married next week.....the stress is unbelievable.

They are not Bailiffs, just collectors, they have no powers, so sleep easy.
When did you last make payments on these debts?
On Monday phone CCCS and make an appointment, but have your paperwork neat and tidy before then. In the meantime enjoy he TV, dont matter if they hear it or not, just dont answer the door.
Believe me your problem isn't as bad as you think, and will be resolved

Might also be worthwhile taking a look at your credit report - don't think anyone's suggested that yet.
Google experian and you can see your credit report for free (but cancel within 30 days). This should show what accounts you have and any defaults.
To help with your SOA, the calculator may be useful - then just paste it up in the MSE format and hopefully we can find some savings for you.

For the debts that are currently with the DCA's I'd send the template letters requesting a valid copy of the CCA. Not often much good if they are chasing an overdraft debt, but while a debt is in dispute they cannot start court proceedings. This should hopefully buy you some time while you comtact payplan or CCCS as already suggested.

If I can echo the posts above - they are not bailiffs, they are Field Collectors and have no rights whatsoever. If they do arrive, say you are not speaking to them and they have no right to be calling on you.
PLEASE call CCCS as soon as you can.
I also want to say well done for opening all the post and facing it - it takes guts - you're a strong woman and can move forwards now to tackle the debts.

Just one thing if any judgements were made against you they wouldn't show up at the local courts would probably be at the county court local to the creditor or Northampton bulk court centre.
Check your credit file to be sure you have no CCJs registered against you. Then get onto CCCS on Monday, blow a sicky if you have to.0
