Thanks CQ - I wasn't aware of this. So if you had been able to demonstrate that you could pay that particular creditor off in 7 years, would that mean it would have remained as a CCJ? If so, isn't that giving preference to one creditor? I thought Judges didn't encourage that

All my creditors but one have frozen interest so the debt is slowly but surely coming down. I pay just under £300 per month (but am about to increase that amount) and it is spread pro rata amongst all my creditors.
The creditors know I'm a homeowner because my I&E which they all have shows my mortgage payments, but none of them (so far :T) have applied for a CCJ, which they have to be granted before they can go for a Charging Order.
Even if they ALL went for CCJ's, which I would have to default on before they could apply for and be granted a Charging Order, that still does not mean you are forced to sell your home. What it means is that when the house is sold, they are paid the money still owed to them after the mortgage has been cleared. I don't plan to sell my home for at least 15 years (when the mortgage ends) by which time all my debts will be cleared anyway.
I've been single for many years and now that my daughter is away studying at University, I'm not entitled to any benefits or credits so I'm doing this alone and under my own steam by working full time and budgeting hard. Well not really under my own steam but with the help and support of the CCCS who have never suggested I sell my house. In fact, they said I should try and keep my home if at all possible.
If you really want to stay in your property, then please do talk to the CCCS or Payplan, who will negotiate with your creditors on your behalf and help you with budgeting. They've been fantastic but actually it's because of this site that I've learnt even more about budgeting and taken inspiration from other DFW's which has enabled me to be in a position to increase my monthly payments to my creditors.
Wishing you all the best

I'm in a similar position to ILC. I'm on a DMP with CCCS and have been for 3 months and paying less than £300 pm but due to changing my spending habits and mega budgetting I've already increased my payments to them. Originally I was told by the CCCS it would take me 9 years to clear my debts but as I am due to pay my mortgage off in 5 years, I intend to clear my debts before my mortgage free date. I am single and own a house and CCCS said a DMP was the best option for me as I only have a small mortgage and can't afford to remortgage on my salary, and they agreed that if I was to sell my house to pay my debts and rent somewhere I would be paying more in rent that I currently am on my mortgage as I live in an expensive area of the country.
Perhaps you could try a DMP and you find that you can increase your payments frequently, thus clearing your debts more quickly. I certainly don't intend to take 9 years to clear mine.Debt 30k in 2008.:o Cleared all my debt in 2013 and loving being debt free

Hi ILC
It depends what judge you get really i suppose ,but we thought it was unfair especially to our larger creditors. As the two creditors who are trying to get the charging orders are two of our lowest creditors. We owe six times as much to our highest creditor and they agreed with the DMP from the begining!

Hello i2d
Hope things are starting to get a bit better. With regards to the cards on your credit file - they will be there until they drop off after 6 years. You just need to make sure that the account status is correct - closed. Hello, well well well it looks like Barclay's were true to there words.!!!
They sent me a credit card with an amazing limit......ready......
£260.....!!!!!!!!!
OHHHH now where shall i transfer all that money from.
I have a monthly payment bigger than that.!'Beware of little expenses. A small leak will sink a great ship'. -Benjamin Franklin.0 -
Not exactly something to get excited about - but you may as well use it. In about 6 months you should be able to ask for an increase in the limit. Hopefully it will be substantial. After that i would use the card a few times just to show that you will pay it off, then threaten to close it and hopefully they'll try to give you an incentive to stay.
Not the best new i'll admit, but at least it wasn't a charge. A cloud with a silver lining - but it's still a bloomin' cloud!!After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

Hi again! See the barclaycard as a real positive - ok you didn't get a fab credit limit, but at least you got one!! I have no "bad credit", no defaults, no missed payments etc, and I cannot get a new card for love nor money......no idea why!!
Anyway, did you decide whether to go with CCCS or work at the debt another way? Let us know how you are tackling things, then we can help you come up with some more ideas!Successful women can still have their feet on the ground. They just wear better shoes.
