  • There have been many such cases recently which have been won, some by the Banks settling 'out of court' (perhaps because they knew they'd lose?!) some by the Judge agreeing that these charges are in fact penalties and as such are not enforceable in law........

    Sorry Linda, you start a nice new shiny thread, only to have it hijacked!

    After I'd sent my first letter, if I'd had no respone I had planned to send a second one which basically said the same thing but with more detail and mentioning previous cases such as the 'Dunlop Pneumatic Tyre Co. Ltd v New Garage and Motor Co. Ltd' and generally being more specific about the legality of it all and my intention to take it to court.

    I think someone is either too dim to comprehend what tina and cat are saying or they are just angling for an arguement.

    I for one will be writing to the halifax as they have hammered me with "penalties" taking £175 in one month!

    Whilst a "Contract is a Contract" if it can be challenged, then why not? This site is all about "Saving Money & Being Nice to Other Money Savers". It's informative to read others opinion but there really is no need to make the discussions personal.

    Please keep the thread on topic & be nice or I will have to ask the abuse team to take a look & appropriate action if necessary.

  • Well good luck BigDan, like I said at the start, they have totally ignored my inital request to remove the charge and just put it on anyway, my next letter (and the whole point of my original post!) will be to inform them that I will go to Court if the charge is not removed in 14 days, no doubt I'll be getting another charge tomorow as I now have insufficient funds available for a DD because I've got £39 less than I thought I would have!! :)

  • Thank You Tony H, some people make you feel like just not asking anything anymore and I actually felt quite hurt by a couple of those (uncalled for) opinions.

    Oh, don't get me wrong, I haven't come up with this or my other letter myself - other posters have been good enough to post links to useful sites along the way, and all the info can be found there - I just reword my letters a little.

  • btw - what option do we have but to sign these contracts agreeing to whatever, If you don't sign you can't open an account, no account = no wages, 'catch 22' I think!?
