Agreed it's harder in chip-and-pin times. I can't see a situation where the merchant would ask the customer to hand the card over!0 -

I disagree. They ask the shop to retain usually only in a handful of situations - if the card is reported stolen, if the issuer has cancelled it, etc.
If that is the case, the issuer doesn't trust you to return it, so will ask the retailer to do this.
It's perfectly reasonable, lawful, and not up to you as the cardholder to argue with.

Why do you keep parroting this line while totally ignoring my point that the retailer cannot prove their entitlement to retain the card?
Once again, the card holder has an obligation to safeguard their card & pin, and this is not compatible with allowing a stranger to take it just because they say they can.0 -

You're right, at the end of the day whether an electronic terminal asks for my card or not - ultimately I am responsible for it and i'd refuse - simple.
Legally (as ive already stated) there is nothing the Police could do, its a civil matter and to be fair, the assistant would hand my card back without threats cos the police would insist they do.
The shop has no legal right to touch my card, let alone retain it.
I'm in 100% agreement with you and may report my card as stolen this morning then try and use it later and see what happens.... HMV is a good place to start then i'll try Game or something....
I'll update later....
p.s. if the shop tries to retain it, i'll make whatever threats I deem necessary in order that the store either return the card to me or call the police so I can prove my theory is correct lol.

Not at all, if someone took my wallet or the wifes bag then i'd act the same way..... I think you're getting too drawn into this and need to sit back and realise that no self respecting person would give up their bank card as easily as that - we're told not to by our banks!
However, to stop the argument its true that the assistant really has no need to touch our card so in all honesty the feasibility of them retaining our card is soooo very slim (in todays market).2010 - year of the troll

I agree."Please retain card" messages were more useful before the chip-and-pin days, as it wasn't a case of snatching the card, it was a case of not returning it.
In probably 90% of situations where you're asked to retain, it's as the card has been reported stolen. In the other 10%, it will be the bank telling the customer to stop using the card and sending it back (for repeated violations etc) and the customer ignoring this. However there is the odd occasion where it is neither of these, this shouldn't happen too regularly, as marking a card as "please retain" is usually the last resort for a bank if they don't know the card is compromised.0 -

Exactly - I agree 100% (as before)... they bank would not say retain this card just for going £1 overlimit - it'd have to be either fraud, cancelled card or abuse of terms that would warrant such action....2010 - year of the troll
