Excel Parking finally take someone to court over an unpaid 'parking ticket'..and LOSE

A friend of mine recently received parking fine from Excel Parking. She ignored as per instructions after doing research. 3/4 weeks ago she returned to her car and found it clamped. She was told to pay £1,000 fine. She refused, this then went up and up and up and finaloly reached around £3,500. Because she refused to pay they towed her car away - even after the police had attended.
She legally had to give them notice to return her car. She has now been told that they are becoming the legal owners of her car (which is a BMW worth approx £10k) and they have made agreement with her finance company.
Has anyone else heard of any such thing like this? The legal advice she has been given so far is either to quit or drastically reduce her full time work so she cant pay anything back!
It all seems very wrong to please. Please help!

I think if Excel had lifted a £10k beemer, it would be in at least 1 local rag. I severely doubt that the HP company would even consider accepting payment in return for ownership without at least checking with the original loan applicant.Never Knowingly Understood.

The idea of gangs of roaming car clampers travelling the land with unlimited authority to target cars, even those not legally owned by the those they hunt, appears to be a fantasy unique and peculiar to DCA's. Their fixation with cars is becoming as embarrassing as adult bed wetting.
Courts do NOT and can NOT empower a bailiff to take property not owned by someone he is collecting money from, and a car on HP is owned by the HP company.Never ever give your card details to anyone over the phone, and check the reputation of any company you do intend to give them to.0 -
You will see similar posts occasionally over on the parking forum. They all seem to follow the same script, and always from a first-time poster. It usually goes:_
"I followed all the advice on here about ignoring, but yesterday I lost in court and had to pay £500. Not only that, but there were five other motorists in the same court being prosecuted by the same PPC and they all lost."

Yes, when a car is removed other than in accordance with statutory powers by or on behalf of local authority or police, it can prove to be very expensive for whoever removes it (I'm also excluding a hire purchase company "snatch-back" when the HP customer fails to make the payments due)... see here:

If you are able to, PM or post more details about the original "fine" and seizure - e.g. was it taken from a road or from private property, etc.?
EDIT: Doh...! Didn't spot that Vick1t was a one-post wonder. Any person reading this thread who has received a "terrorgram" private parking company demand for payment, do not be put off by these scare stories! Read the genuine posts by those who want to help you - trust their real-life experiences that these demands are empty threats, designed to frighten you into paying!! If still in doubt, follow the advice to post the (anonymised) details for more specific assistance.0 -

Always makes me laugh this, they win "all" these cases yet only ever use the Thomas one as a lever, and that goes back to 2008I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -
